482 Visa Refused After Nomination Approval: ART Review and Next Steps

Updated September 2026. An approved Skills in Demand (Subclass 482) nomination does not automatically mean the associated visa application will be approved. The nomination and visa are separate decisions. The employer may satisfy the nomination requirements while the applicant still fails a visa-level criterion.

For advice about a refusal, see our Subclass 482 service and Visa Refusal service.

Why can a 482 visa be refused after nomination approval?

Depending on the stream and circumstances, a visa refusal may relate to English, skills and work experience, licensing or registration, health, character, identity, previous immigration information, or another applicant-level requirement.

The correct strategy starts with the actual refusal paragraph. Do not assume the Department rejected the position simply because the visa was refused.

Does the approved nomination remain useful?

Possibly, but nomination validity and the relationship between the nomination and any further visa application need to be checked. A refusal does not automatically mean an approved nomination can be reused indefinitely.

Can a 482 refusal be reviewed by the ART?

Some 482 refusal decisions may be reviewable. The refusal letter should state whether review rights exist, who can apply and the deadline. Jurisdiction can depend on matters such as the applicant’s location and sponsorship circumstances.

ART deadlines are strict. A strong review application should be based on the refusal reasons rather than simply re-uploading the original documents.

What evidence may be important at review?

  • the visa refusal decision;
  • the approved nomination;
  • skills and employment evidence;
  • English results where relevant;
  • registration or licensing documents;
  • health and character correspondence;
  • documents explaining inconsistencies; and
  • a written submission addressing the specific criterion in dispute.

ART review or a fresh application?

A fresh application may be considered where a missing requirement can now be satisfied and a valid new application is available. ART review may be preferable where the applicant says the delegate misunderstood the evidence or wrongly applied the criterion. Sometimes both options need to be analysed before the review deadline expires.

What happens to your current visa status?

If you are in Australia, check VEVO immediately. Bridging visa status, work rights and travel rights can depend on the application history and whether a valid review is lodged. Do not assume an ART application automatically gives unrestricted travel rights.

Official guidance

Home Affairs provides current information about the Skills in Demand visa. Refusal notices state whether ART review rights are available.
