Adult Child Visas and Disability: Dependency Evidence and the Health Requirement

Child & family migration · Updated 29 September 2026

A family supporting an adult child with a disability may face two different migration questions. First, can the child meet the relevant dependent-child definition and age or study provisions? Second, does the child meet the visa health requirement, or is a waiver available and justified? Evidence that helps one question does not automatically decide the other.

Quick answer: The disability-related dependent-child limb requires a specific assessment of incapacity for work. It is not established by a diagnosis alone. Child Visa 101 and 802 health criteria must then be assessed separately, including PIC 4007 and any legally available waiver.

The legal question concerns function, not a diagnostic label alone

The relevant dependent-child definition addresses incapacity for work because of total or partial loss of bodily or mental functions. A medical diagnosis can be important evidence, but the lawyer needs to understand its functional effect and how it fits the statutory wording. Difficulty finding a job or a parent’s preference that the child not work is not the same analysis.

Describe the child’s abilities, limitations, support needs, treatment and employment history accurately. Do not reduce a person to a diagnosis or assume that every person with the same condition has the same capacity. A detailed report may explain the individual circumstances more effectively than a short certificate stating only that the child has a disability.

How the age and study exceptions fit

For 101 and 802, the ordinary under-25 and adult study requirements have specific exceptions linked to the disability-related dependent-child limb. These provisions need to be read with the other applicable criteria and the facts at application and decision. They should not be summarised as a blanket exemption from every Child Visa requirement.

The qualifying parent relationship, sponsorship, relationship history and other relevant matters still need assessment. A case involving an adult who has previously married, for example, cannot be resolved simply by obtaining a medical report. Establish the complete history before deciding which pathway is available. Location and application-validity requirements also remain important.

    Prepare functional and support evidence

Useful evidence may include specialist reports, treatment history, assessments of daily functioning, education and employment records, and a clear description of support provided by family or services. Explain what assistance is needed, how often and why. Where reports differ, investigate the reason rather than selectively omitting unfavourable material.

Ask the clinician to address matters within their expertise using accurate instructions. A lawyer can explain the legal question, but should not dictate a medical conclusion. Financial records and care arrangements can provide context, while the functional evidence addresses the work-incapacity question. The aim is a coherent account of the individual’s circumstances, not a large collection of unrelated medical documents.

The visa health requirement is a separate stage

A person may satisfy the disability-related dependency provisions yet still require assessment under the visa health criterion. Home Affairs medical processes and the Medical Officer of the Commonwealth have distinct roles. The family should obtain the relevant assessment and understand whether the issue concerns public health, costs, access to services or another aspect of the criterion.

For Child Visas 101 and 802, PIC 4007 is relevant under the current Regulations. A waiver is not automatic simply because a parent can offer support or the child has a compelling family history. Nor should a family assume that a diagnosis inevitably means refusal. Apply the criterion and any waiver provision to the actual medical opinion and evidence.

Building a health-waiver response where available

A response should address the specific assessment, the applicable waiver test and the evidence supporting the family’s circumstances. Depending on the issue, this may involve clarification of prognosis and service needs, reliable information about support and a properly explained compassionate case. General assurances that the family will pay for everything are not a substitute for analysis.

Do not promise to decline all public services or obtain private insurance on the assumption that this automatically defeats the medical assessment. The relevance of proposed arrangements must be examined under the legal framework. If the Department has issued a request or adverse-information invitation, preserve the complete notice and deadline and obtain advice promptly.

Planning the case with dignity and realistic costs

Discuss how the adult child participates in instructions and what communication or support adjustments are needed. Legal capacity and who may provide instructions should be handled appropriately. Sensitive medical information should be collected for a defined purpose and shared through the agreed process.

A complex dependency or health case can involve reports, translations and additional submissions beyond a routine application. Ask for a written professional scope and clarify which specialist expenses are separate. Emigrate Lawyers can assess the migration strategy and coordinate the legal response, while clinical opinions remain the responsibility of the treating or assessing professionals. No approval or waiver outcome should be guaranteed.

Department fees and the total cost of a child visa matter

The Department’s standard base application charge, checked on 29 September 2026 against Schedule 1 of the Migration Regulations, is AUD 4,040 for subclasses 101, 802, 102 and 445. For Orphan Relative subclasses 117 and 837, the standard base charge is AUD 2,475. These are government charges, not Emigrate Lawyers’ professional fees. The charge applicable when a valid application is made must be checked before payment.

Do not assume a child pays an additional-applicant rate merely because they are young. A child who makes their own primary application generally attracts the base charge. Siblings normally require separate Child Visa applications. Additional-applicant charges concern eligible people properly included in an application, such as an applicant’s own dependent child.

      Cost componentWhat to budget for
Government chargeStandard base fee above; check concessions and any eligible additional applicants.
Evidence and checksTranslations, police certificates where required, panel medical examinations and document retrieval.
Professional assistanceAn agreed legal scope and written fee quote, with GST treatment and disbursements identified.
Complex issuesForeign-law advice, court proceedings, specialist reports or review work may need a separate scope.

Eligible Pacific-regional passport holders can receive lower charges: the relevant Schedule 1 categories currently provide a base of AUD 3,315 for the usual Child/Adoption/445 pathways and AUD 2,030 for Orphan Relative applicants. Specific welfare-authority-supported onshore applications also have special rules. Eligibility, not financial hardship alone, determines the concession. Ask for a calculation for the actual applicant rather than relying on a generic fee screenshot. Check Home Affairs visa pricing.

Processing times: what the Department’s figures mean

The Home Affairs processing tool reports how long recently decided applications took. It does not reserve a decision date for your child, identify the case officer, or give a different service standard for each Australian city. The official processing-time guide should be checked for the exact subclass before making travel or school commitments.

At our 29 September 2026 check, the tool displayed 21 months for 50% and 30 months for 90% of Subclass 802 applications. These historical percentiles are not a minimum wait, a guarantee, or figures that can be transferred to another subclass. The tool showed an update date of 4 September 2026. An application outside the published range warrants a careful status check; it does not automatically establish an error or a right to immediate approval.

Keep the acknowledgement, payment evidence, application reference and copies of everything submitted. Monitor Department correspondence and update changed passports, addresses and relevant family circumstances. A targeted enquiry should explain what is outstanding and provide evidence of any urgent circumstances. Repeated identical emails, a school start date or payment of a higher legal fee do not create a guaranteed fast-track service.

Case example: an adult child with mixed evidence about work capacity

Illustrative case example: This is a hypothetical scenario to explain the legal issues, not a reported client result.

A family supports a 27-year-old child with a longstanding condition. One medical letter lists the diagnosis; another describes limited part-time activity with substantial assistance. The legal task is to establish the actual functional position and assess the disability-related dependent-child definition, not select whichever label sounds most favourable.

If a Child Visa pathway is available, the health criterion must then be addressed separately. The family may need more detailed specialist evidence and a response to a Department assessment. This example illustrates distinct legal questions rather than an assumed entitlement to a waiver.

      The Emigrate Lawyers method

Our approach starts with the legal question that could decide the matter. For this article’s scenario, that means separating functional dependency evidence from the health assessment and responding to each legal test on its own terms. The file should explain why the evidence meets the relevant rule, rather than leave the decision-maker to infer the answer from a large collection of documents.

      1. Map the family and status history. Identify the applicant, proposed sponsor, parental responsibility, previous applications and relevant dates.
      2. Test the pathway before paying. Check the subclass, location, application validity, sponsorship and any exception that must be established.
      3. Build an evidence plan. Separate documents already available from material that needs translation, independent verification or specialist advice.
      4. Prepare a consistent application. Reconcile forms, supporting statements and earlier immigration records, explaining genuine discrepancies.
      5. Manage the period after lodgement. Track requests, changing circumstances, visa conditions and any time-sensitive response.

Emigrate Lawyers is based at Suite 807, 365 Little Collins Street, Melbourne VIC 3000 and assists clients throughout Australia and overseas through a paperless practice. Remote service does not remove a requirement to attend a medical examination, biometrics appointment or court process where one is needed. We explain the agreed work and professional fees before that work begins; no lawyer can guarantee a visa grant or Department processing speed.

      Frequently asked questions

Does disability remove the Child Visa age limit?

Specific age and study exceptions can apply through the relevant dependent-child limb. They do not remove every other eligibility, validity or health requirement.

Is a diagnosis enough to establish incapacity for work?

Not necessarily. The functional impact and the precise statutory test need to be addressed with appropriate evidence.

Does a Child Visa health waiver always exist?

Check the actual subclass and criterion. PIC 4007 is relevant to 101 and 802, but availability and satisfaction of a waiver are separate questions.

Will private health insurance guarantee approval?

No. The medical assessment and waiver framework must be applied. Insurance or family support may need analysis but is not an automatic answer.

Can we respond without a lawyer?

Applicants can act for themselves, but complex medical and legal issues may benefit from tailored advice. At minimum, identify the exact request, criterion and deadline before responding.
