Partner Visa While Living Apart: FIFO Work and Long Separations
Sources checked 18 September 2026
A Partner visa while living apart requires a clear account of the relationship, including why you live separately and how your life together continues. FIFO work, overseas employment, caring responsibilities and travel restrictions can produce very different histories. A generic long-distance checklist cannot establish eligibility.
Start with your actual dates and arrangements. Then identify the records that help explain each period away.
What should the evidence explain?
Regulations 1.09A and 1.15A address the relationship’s financial, household, social and commitment circumstances. Physical distance needs to be understood within that wider history. Obtain advice about your relationship type and applicable visa criteria; do not assume that living apart either proves or defeats eligibility.
Build a timeline of time together and time apart
Use one row for each meaningful period. Separate the date the relationship began, the date of any shared residence, the beginning of a work placement and the dates of visits. Mark an uncertain date as approximate rather than choosing a precise day without a basis.
| Period | Explanation | Existing records to consider |
|---|---|---|
| FIFO roster | Worksite, roster pattern and time at home | Rosters, travel records and actual household arrangements |
| Extended overseas work | Reason for the placement and changes to the plan | Employment correspondence, visits and shared decisions |
| Family care abroad | Who needed care and how this affected plans | Relevant care or travel records, where safely available |
| Travel prevented or postponed | What changed and when | Cancellation notices and contemporaneous correspondence |
The table is an organisation aid, not a compulsory evidence list. Keep a note of what is unavailable and why. Do not alter rosters or ask an employer to describe an arrangement that did not exist.
How to present FIFO partner visa evidence
Explain the working pattern in plain language: the usual time away, where the worker stays and where the couple spends time together. Clarify whether the roster was stable or changed. A payroll address or work accommodation address may differ from the address used for personal correspondence; explain the distinction accurately.
Connect records to the relationship. A roster can show an absence, while genuine records of shared expenses, household decisions or visits can explain life outside work. Avoid treating every work trip as a separate relationship breakdown.
Example: changing roster arrangements
If a worker changed from a two-week roster to a longer placement, show the transition and its effect on visits and responsibilities. Use actual dates and records. This hypothetical example illustrates file organisation, not a visa outcome.
Explain a long separation without filling gaps with assumptions
Describe why the separation continued, what each person understood and how plans changed. Distinguish an intention to reunite from a completed move. If a proposed visit did not happen, do not present a booking as proof that it did.
Choose communication records that help explain support, practical decisions and significant events. Keep originals and show the relevant context. A large screenshot bundle cannot resolve inconsistent accounts about where someone lived or whether the relationship continued.
Keep both accounts accurate and independent
- Check dates against travel and address records.
- Explain how expenses and household responsibilities operated during absences.
- Identify which events each person directly remembers.
- Distinguish temporary absence from uncertainty about the relationship itself.
- Discuss any genuine breakup, reconciliation or safety concern privately with your lawyer.
Do not write identical statements to create an appearance of agreement. If your memories differ, identify the difference and investigate available records rather than adjusting facts to match.
Frequently asked questions
Is there a maximum separation that guarantees acceptance?
No duration in this guide guarantees a result. Your lawyer needs the full history, the reason for the absence and the applicable criteria.
Do future plans replace evidence of the relationship so far?
No. Explain plans truthfully, including whether they remain tentative, and provide relevant evidence of what has actually occurred.
Should we change addresses just to make documents match?
Records should reflect the real arrangement. Explain different residential, work and postal addresses instead of creating misleading consistency.
