Can My Employer Cancel My 482 Visa? Job Loss, Sponsor Changes and the 180-Day Rule
Updated September 2026. If your employer says they will “cancel” your Subclass 482 Skills in Demand visa after you resign, are dismissed or raise a workplace complaint, the first point is important: an employer does not have the legal power to cancel your visa. Home Affairs states that only the Australian Government can grant, change or cancel a visa.
Your employer can, however, notify the Department that your sponsored employment has ended. That notification can affect your future options and means you should deal with your visa position promptly.
For advice about your sponsored visa, see our Subclass 482 Skills in Demand service.
Who can actually cancel a 482 visa?
Only an authorised decision-maker exercising powers under the Migration Act can cancel a visa. Your sponsor cannot log into a system and cancel the visa themselves. Home Affairs’ migrant-worker guidance expressly says employers cannot cancel a worker’s visa, even where a visa condition may have been breached.
What can the employer do when employment ends?
An approved sponsor has notification obligations. If sponsored employment ceases, the sponsor can notify Home Affairs of the cessation. The Department may then have information showing that you are no longer working in the nominated position.
This is different from visa cancellation. It is a change in the factual circumstances underlying the sponsorship.
How long can you remain without the sponsoring job?
Current Home Affairs guidance for the Subclass 482 states that a sponsored worker who has lost their job may have up to 180 days to find a new employer or make arrangements to leave Australia. The Migration Regulations also limit the total period away from the required sponsored employment over the visa period.
Do not treat the 180 days as a new visa expiry date. Your existing visa must still be valid and all other conditions continue to matter.
Can you work for someone else during this period?
The sponsored-worker mobility rules permit greater flexibility than the older 60-day framework, but work rights are still governed by condition 8607 and your individual grant. Before starting with another business, check whether a new nomination is required and whether the proposed work is consistent with the occupation and sponsorship rules applying to you.
Does a new employer need to sponsor you?
Usually, a new employer who wants to retain you under the sponsored skilled visa framework must have the appropriate sponsorship status and lodge the required nomination. The exact process can depend on the visa grant, occupation and whether a further visa application is required.
Do not rely only on an employer’s HR team saying that a “transfer” is automatic.
What if your employer is threatening cancellation because you complained about pay?
Migrant workers have the same workplace protections as other workers in Australia. Home Affairs specifically warns that employers cannot cancel a visa and provides reporting protections in some exploitation situations.
If there are unpaid wages, threats, coercion or exploitation, preserve employment records, messages, payslips and rosters. Migration advice and employment-law advice may both be required.
Can Home Affairs later cancel the visa?
Potentially, yes. Visa cancellation is a separate legal process. The Department may consider cancellation powers where visa conditions are breached or other statutory grounds arise. Whether cancellation is considered depends on the actual circumstances.
If you receive a Notice of Intention to Consider Cancellation, do not confuse that with an employer’s threat. A departmental notice is a formal legal process and usually has a response deadline.
What should you do immediately after losing a sponsored job?
- Check your visa expiry date and conditions in VEVO.
- Record the exact last day of sponsored employment.
- Keep the termination or resignation correspondence.
- Start assessing new sponsors and other visa options early.
- Do not assume the 180-day period removes all work-condition restrictions.
- Get advice if the employment ended because of exploitation, redundancy or a dispute.
Official guidance
Home Affairs states that employers cannot cancel visas on its Information for migrant workers page. Current 482 guidance also explains that a worker who loses their job may have up to 180 days to find a new employer or arrange departure.
