Can a Child Visit Australia While a Subclass 101 Visa Is Pending?
Parents waiting for Subclass 101 often ask whether their child must remain overseas for the entire processing period. A temporary visit may be possible, but it is a separate immigration decision. The family needs a truthful Visitor Visa strategy, a plan for the permitted stay and advice about the permanent application’s location requirements.

A permanent application does not create temporary entry rights
A 101 application seeks permanent residence under its own criteria. It does not itself allow the child to board a flight, enter Australia or remain after another visa expires. A parent holding Australian citizenship or permanent residence cannot extend their own status to the child merely through sponsorship.
If a temporary visit is proposed, identify the appropriate visa and assess the child’s passport, purpose, care, support and intended stay. A visa grant also needs to be read carefully: the last date for entry, permitted stay after entry and conditions can be different. Do not reduce the analysis to the single expiry date displayed in a family calendar.
Explain the proposed visit honestly
An intention to pursue permanent residence through a pending application should not be hidden. The temporary application should explain the real proposed visit and how the family will comply with the temporary visa’s requirements if the permanent application is not decided in time. The Department assesses the evidence and circumstances.
Do not describe a permanent relocation as a short holiday if that is not the genuine plan, or manufacture return arrangements solely for appearances. A lawyer can help present the facts accurately and identify whether a temporary strategy is viable. Honesty does not guarantee approval, but a misleading application can create a much more serious problem for the family.
Check conditions before assuming an onshore option exists
Some temporary visas carry conditions affecting further applications, study, work or length of stay. A No Further Stay condition may be particularly important. The fact that a parent intends to apply for 802 does not itself remove a restrictive condition. Any waiver has its own requirements and process.
If the child is already in Australia, review the full grant notice and visa history before making a new application or allowing the current visa to expire. Section 48, previous refusals and other validity provisions may need analysis. Child (Residence) has specific rules; it should not be described as either universally barred or universally available after a refusal.
Location at grant: a critical offshore distinction
For new 101 applications, the ordinary rule requires the applicant to be outside Australia at grant. The Regulations contain a limited historical concession for particular earlier applications and presence during the concession period. That exception should not be generalised to a newly lodged case.
If the child visits while waiting, keep the Department informed as required and obtain advice about any request to depart for finalisation. Do not plan a last-minute trip without checking the notice, the child’s other visas and travel documents. Nor should the child leave solely because someone online says every 101 applicant must depart at the same stage. Apply the actual rule and instructions to the case.

A bridging visa is not automatically attached to an offshore case
Parents sometimes hear that permanent visa applicants receive bridging visas and assume the same result follows from a 101 application lodged overseas. That is unsafe. The existence and effect of a bridging visa depend on the relevant application and status circumstances, and the child needs actual evidence of any grant.
A pending offshore application is not a substitute for maintaining lawful temporary status during a visit. If a new onshore pathway is being considered, assess validity and the consequences before lodging. Do not let the Visitor Visa expire while waiting for a bridging visa that has never been granted. Our 802 bridging visa guide explains the distinct onshore issues.
Schooling, healthcare and the cost of a longer stay
A visit may become expensive if processing takes longer than expected. Consider accommodation, insurance, school arrangements, travel and the need to comply with any study limitation. A school enrolment does not override visa conditions. Medicare eligibility requires its own Services Australia assessment and should not be assumed from the parent’s card.
Before committing to a long stay, compare realistic scenarios: the temporary visa is refused, the visit ends before the permanent decision, or the child needs to travel for grant. A lawful contingency plan is more useful than a single optimistic timetable. Professional fees for a temporary application are also separate from the Child Visa charge and may need their own scope.
Department fees and the total cost of a child visa matter
The Department’s standard base application charge, checked on 29 September 2026 against Schedule 1 of the Migration Regulations, is AUD 4,040 for subclasses 101, 802, 102 and 445. For Orphan Relative subclasses 117 and 837, the standard base charge is AUD 2,475. These are government charges, not Emigrate Lawyers’ professional fees. The charge applicable when a valid application is made must be checked before payment.
Do not assume a child pays an additional-applicant rate merely because they are young. A child who makes their own primary application generally attracts the base charge. Siblings normally require separate Child Visa applications. Additional-applicant charges concern eligible people properly included in an application, such as an applicant’s own dependent child.
| Cost component | What to budget for |
|---|---|
| Government charge | Standard base fee above; check concessions and any eligible additional applicants. |
| Evidence and checks | Translations, police certificates where required, panel medical examinations and document retrieval. |
| Professional assistance | An agreed legal scope and written fee quote, with GST treatment and disbursements identified. |
| Complex issues | Foreign-law advice, court proceedings, specialist reports or review work may need a separate scope. |
Eligible Pacific-regional passport holders can receive lower charges: the relevant Schedule 1 categories currently provide a base of AUD 3,315 for the usual Child/Adoption/445 pathways and AUD 2,030 for Orphan Relative applicants. Specific welfare-authority-supported onshore applications also have special rules. Eligibility, not financial hardship alone, determines the concession. Ask for a calculation for the actual applicant rather than relying on a generic fee screenshot. Check Home Affairs visa pricing.
Processing times: what the Department’s figures mean
The Home Affairs processing tool reports how long recently decided applications took. It does not reserve a decision date for your child, identify the case officer, or give a different service standard for each Australian city. The official processing-time guide should be checked for the exact subclass before making travel or school commitments.
At our 29 September 2026 check, the tool displayed 23 months for 50% and 33 months for 90% of Subclass 101 applications. These historical percentiles are not a minimum wait, a guarantee, or figures that can be transferred to another subclass. The tool showed an update date of 4 September 2026. An application outside the published range warrants a careful status check; it does not automatically establish an error or a right to immediate approval.
Keep the acknowledgement, payment evidence, application reference and copies of everything submitted. Monitor Department correspondence and update changed passports, addresses and relevant family circumstances. A targeted enquiry should explain what is outstanding and provide evidence of any urgent circumstances. Repeated identical emails, a school start date or payment of a higher legal fee do not create a guaranteed fast-track service.
Case example: a child visiting a parent during an offshore application
A child has a pending 101 application and the parent wants a three-month visit during school holidays. The temporary application needs an honest explanation of the visit, care and support, and what will happen if the 101 is still pending at the end of the permitted stay.
If a Visitor Visa is granted, the family must read its conditions and plan for the 101 grant-location rule. The pending permanent case does not allow an indefinite extension of the visit. This example illustrates a coordinated strategy rather than an assurance of temporary entry.
The Emigrate Lawyers method
Our approach starts with the legal question that could decide the matter. For this article’s scenario, that means coordinating the temporary visit with the permanent application without misrepresenting the family’s intentions. The file should explain why the evidence meets the relevant rule, rather than leave the decision-maker to infer the answer from a large collection of documents.
- Map the family and status history. Identify the applicant, proposed sponsor, parental responsibility, previous applications and relevant dates.
- Test the pathway before paying. Check the subclass, location, application validity, sponsorship and any exception that must be established.
- Build an evidence plan. Separate documents already available from material that needs translation, independent verification or specialist advice.
- Prepare a consistent application. Reconcile forms, supporting statements and earlier immigration records, explaining genuine discrepancies.
- Manage the period after lodgement. Track requests, changing circumstances, visa conditions and any time-sensitive response.
Emigrate Lawyers is based at Suite 807, 365 Little Collins Street, Melbourne VIC 3000 and assists clients throughout Australia and overseas through a paperless practice. Remote service does not remove a requirement to attend a medical examination, biometrics appointment or court process where one is needed. We explain the agreed work and professional fees before that work begins; no lawyer can guarantee a visa grant or Department processing speed.
Frequently asked questions
Must every 101 applicant stay overseas throughout processing?
The application and grant-location requirements must be met, but a temporary visit may be possible on an appropriate visa. The visit’s legality and conditions are assessed separately.
Will a pending 101 cause automatic Visitor Visa refusal?
There is no useful automatic answer. The Department assesses the relevant temporary visa criteria and the actual evidence, including the family’s disclosed plans.
Can we switch to 802 once the child arrives?
Only after assessing whether a valid onshore application is available and the consequences of maintaining or withdrawing the existing application. Do not assume a simple conversion.
Can my child stay because the 101 is taking too long?
Delay alone does not extend a temporary visa or grant a bridging visa. Obtain advice before the child’s lawful stay expires.
