Child Visa Lawyer Adelaide: Older Children, Study and Dependency Evidence
An older child’s application requires more than proof that the parent lives in Adelaide and still sends money. Age at application, study history, work, relationship status and the legal meaning of dependency can determine whether a Child Visa pathway remains available. Those questions should be assessed before a child finishes a course, accepts full-time work or makes a new application.

Why the child’s age when applying matters
A child who is 17 when a valid application is made is not assessed in exactly the same way as a person first applying at 20. The Regulations expressly distinguish applicants who were under 18 from those already 18 at application. Turning 18 while waiting does not, by itself, transfer an under-18 applicant into every adult-at-application requirement.
Conversely, an adult applicant cannot rely on having been dependent years earlier. Their circumstances at application and the criteria required at decision must be assessed. Applicants approaching 25 also need careful advice; the decision provisions contain specific protection against failure solely because of turning 25, but that does not excuse a failure of the other continuing criteria. Avoid deciding the case from a birthday alone.
Study records should explain the whole timeline
For the ordinary adult student pathway, the Regulations address full-time study leading to a professional, trade or vocational qualification and the timing after turning 18 or completing the equivalent of year 12. A current enrolment letter does not necessarily resolve a lengthy unexplained break or a period of full-time employment.
Collect school completion records, course commencement dates, attendance or progression evidence, qualifications and explanations of any interruption. If a gap relates to illness, institutional closure or another circumstance, obtain contemporaneous evidence. Do not create a course enrolment solely to manufacture a paper appearance of eligibility. The legal question is whether the actual study history and current circumstances satisfy the rule.
Financial dependency: show the support and the need
Transfers from an Adelaide parent can be relevant, but they should be connected to the child’s ordinary living needs. Explain accommodation, food, tuition, transport, medical expenses and other support, together with the child’s own earnings or resources. A transfer labelled gift proves less than a consistent record explaining how the child is maintained.
Where money is sent through a relative, provide the chain of payment and a reliable explanation of its use. Do not conceal paid work, savings or support from another person. The lawyer needs accurate facts to assess dependency and the separate work restrictions in the adult criteria. Overstating hardship can undermine credibility even where a valid case could have been presented honestly.
Disability is a separate legal analysis
An adult child who is incapacitated for work because of loss of bodily or mental functions may fall within a different limb of the dependent-child definition. The ordinary under-25 and study provisions have relevant exceptions, but a diagnosis alone does not establish the full test. Functional evidence and the applicable criterion matter.
Explain what the child can and cannot do, the expected duration, treatment, support and financial circumstances. Assess the visa health requirement separately; satisfying a disability-related dependency provision does not automatically satisfy health criteria or guarantee a waiver. The adult-child disability guide explains the distinction and the evidence needed.

Relationship history and work should be discussed frankly
For applicants already 18 at application, the relevant provisions include not being engaged, not having a spouse or de facto partner, never having had one, and not engaging in full-time work. A relationship label on social media is not determinative, but an actual marriage or de facto history cannot be ignored because the relationship later ended.
Likewise, family support does not necessarily overcome full-time employment. Provide the employment contract, hours, income and dates where work is relevant. A lawyer should identify which requirement creates the problem, rather than simply requesting more bank statements. If this Child Visa pathway is unavailable, alternatives require their own assessment; they should not be presented as automatic substitutes.
Adelaide consultations and preparing a useful first meeting
Emigrate Lawyers supports Adelaide clients remotely from Melbourne. An older child should generally be involved appropriately in the fact-gathering process because they know their own study, employment and relationship history. Ensure the instructions are accurate and that confidential information is handled through the agreed communication process.
Before the meeting, prepare a one-page timeline and send the key documents. State whether an application has already been made, the child’s age on that date and any Department request. A review of an existing application is different from advice on a future one. The professional scope should state whether ongoing updates, submissions about a study gap or a health response are included.
Department fees and the total cost of a child visa matter
The Department’s standard base application charge, checked on 29 September 2026 against Schedule 1 of the Migration Regulations, is AUD 4,040 for subclasses 101, 802, 102 and 445. For Orphan Relative subclasses 117 and 837, the standard base charge is AUD 2,475. These are government charges, not Emigrate Lawyers’ professional fees. The charge applicable when a valid application is made must be checked before payment.
Do not assume a child pays an additional-applicant rate merely because they are young. A child who makes their own primary application generally attracts the base charge. Siblings normally require separate Child Visa applications. Additional-applicant charges concern eligible people properly included in an application, such as an applicant’s own dependent child.
| Cost component | What to budget for |
|---|---|
| Government charge | Standard base fee above; check concessions and any eligible additional applicants. |
| Evidence and checks | Translations, police certificates where required, panel medical examinations and document retrieval. |
| Professional assistance | An agreed legal scope and written fee quote, with GST treatment and disbursements identified. |
| Complex issues | Foreign-law advice, court proceedings, specialist reports or review work may need a separate scope. |
Eligible Pacific-regional passport holders can receive lower charges: the relevant Schedule 1 categories currently provide a base of AUD 3,315 for the usual Child/Adoption/445 pathways and AUD 2,030 for Orphan Relative applicants. Specific welfare-authority-supported onshore applications also have special rules. Eligibility, not financial hardship alone, determines the concession. Ask for a calculation for the actual applicant rather than relying on a generic fee screenshot. Check Home Affairs visa pricing.
Processing times: what the Department’s figures mean
The Home Affairs processing tool reports how long recently decided applications took. It does not reserve a decision date for your child, identify the case officer, or give a different service standard for each Australian city. The official processing-time guide should be checked for the exact subclass before making travel or school commitments.
At our 29 September 2026 check, the tool displayed 23 months for 50% and 33 months for 90% of Subclass 101 applications. These historical percentiles are not a minimum wait, a guarantee, or figures that can be transferred to another subclass. The tool showed an update date of 4 September 2026. An application outside the published range warrants a careful status check; it does not automatically establish an error or a right to immediate approval.
Keep the acknowledgement, payment evidence, application reference and copies of everything submitted. Monitor Department correspondence and update changed passports, addresses and relevant family circumstances. A targeted enquiry should explain what is outstanding and provide evidence of any urgent circumstances. Repeated identical emails, a school start date or payment of a higher legal fee do not create a guaranteed fast-track service.
Case example: an Adelaide parent supporting a university student overseas
An Adelaide permanent resident supports a 22-year-old child who has just completed one qualification and plans to begin another. The family asks whether regular transfers alone will preserve eligibility during the break. A proper assessment examines the child’s age at application, course history, reason and length of the interruption, employment and relationship circumstances.
If the child was already an adult when applying, the continuing study-related criterion requires particular attention. If the application was made before 18, the legal analysis is different. The example shows why an answer based only on the child’s current age can be misleading.
The Emigrate Lawyers method
Our approach starts with the legal question that could decide the matter. For this article’s scenario, that means testing age-at-application rules and building a coherent study, work and financial history. The file should explain why the evidence meets the relevant rule, rather than leave the decision-maker to infer the answer from a large collection of documents.
- Map the family and status history. Identify the applicant, proposed sponsor, parental responsibility, previous applications and relevant dates.
- Test the pathway before paying. Check the subclass, location, application validity, sponsorship and any exception that must be established.
- Build an evidence plan. Separate documents already available from material that needs translation, independent verification or specialist advice.
- Prepare a consistent application. Reconcile forms, supporting statements and earlier immigration records, explaining genuine discrepancies.
- Manage the period after lodgement. Track requests, changing circumstances, visa conditions and any time-sensitive response.
Emigrate Lawyers is based at Suite 807, 365 Little Collins Street, Melbourne VIC 3000 and assists clients throughout Australia and overseas through a paperless practice. Remote service does not remove a requirement to attend a medical examination, biometrics appointment or court process where one is needed. We explain the agreed work and professional fees before that work begins; no lawyer can guarantee a visa grant or Department processing speed.
Frequently asked questions
Can an adult child qualify if I still pay their expenses?
Possibly, but financial support alone is insufficient. The applicable age, dependency, study, work and relationship criteria must also be assessed.
Does turning 18 while waiting mean automatic refusal?
No. The Regulations distinguish applicants who were under 18 at application from adult applicants. Other requirements still need to be met.
Is every study gap acceptable?
No. The timing and reasons need to be assessed against the actual provision. Documentary evidence can explain a gap but cannot replace a legal requirement.
Can we consult remotely from Adelaide?
Yes. Send the age-at-application details, education chronology, visa records and any request letter so the consultation focuses on the correct legal questions.
