Medicare and Schooling While a Child Visa Is Pending: What Parents Need to Check

Child & family migration · Updated 29 September 2026

A pending Child Visa raises questions that extend beyond the Department application: can the child enrol in Medicare, start school or use the parent’s existing entitlements? Immigration status, healthcare and education are connected, but they are administered under different rules. A parent should not assume that one approval settles all three.

Quick answer: An eligible permanent-residence applicant living in Australia may qualify for Medicare before visa grant, subject to Services Australia rules. School admission, tuition fees and visa study conditions require separate checks. A 445 pathway has an important permanent-stage application step.

Explore our Australian Child Visa hub and our Child Visa 802 service for the underlying visa pathway.

When a permanent-residence applicant may enrol in Medicare

Services Australia states that a person living in Australia who has applied for permanent residence, other than the excluded parent-visa situation, may be eligible if they also meet an additional qualifying condition. That can include a visa allowing work or a qualifying parent, spouse or child with Australian citizenship, permanent residence or New Zealand citizenship while living in Australia.

For a child, the qualifying parent’s evidence may therefore be important even where the child is too young to work. Eligibility is not established merely by a tax payment, a school place or an intention to lodge later. Provide evidence of the actual permanent application and current circumstances, and confirm the coverage date with Services Australia.

Documents and dates: make the child’s position clear

Prepare the child’s identity and passport details, visa information, evidence of the permanent-residence application and the qualifying family relationship and status. If the application was lodged offshore and the child later came to live in Australia, the relevant coverage date needs to be assessed on that history rather than assumed to run from overseas lodgement.

Keep the Services Australia outcome and any expiry or renewal information. Correct mismatched names or passport details through the relevant processes. If a family is asked for more information, identify whether the issue concerns identity, residence or the permanent application. A visa acknowledgement can be useful evidence, but it is not itself a Medicare card or confirmation that every service will be covered.

Subclass 445 requires attention to the permanent stage

Home Affairs explains that after a 445 grant the child must apply to be added to the parent’s permanent Partner Visa application. Its guidance links Medicare enrolment to submission of that permanent-stage addition. Families should not stop their legal work after receiving the temporary 445 grant.

Keep proof of the permanent-stage request and obtain advice if the parent’s permanent visa is about to be decided or has already been granted. The distinction is important: declaring the child, obtaining 445 and becoming an applicant for the permanent stage are not identical events. See the 445 timing and permanent-stage guide for the immigration sequence.

School admission and school fees are separate decisions

Schools and State or Territory education authorities assess admission and any applicable tuition arrangements using their own rules and the child’s actual status. Public school does not automatically mean every temporary visa holder is exempt from fees. Nor does a permanent visa application itself settle every enrolment or fee question.

Ask the school or relevant authority to confirm the position in writing using the child’s subclass, current visa, age, address and proposed start date. Check the visa’s study conditions separately. Do not enrol on the assumption that a school acceptance letter overrides a Visitor Visa limitation. This guide intentionally does not publish one national school-fee figure because a single amount would be misleading.

Healthcare gaps, insurance and planned treatment

A family should identify any gap between arrival and confirmed Medicare eligibility, and any treatment not covered by Medicare. Private insurance can have its own exclusions, waiting periods and limits; read the policy rather than assuming that the word comprehensive resolves every need.

For ongoing treatment, keep clinical records and arrange appropriate continuity of care. Necessary medical attention should not be delayed because a visa or enrolment question is unresolved. Ask the provider and Services Australia about the practical billing position while eligibility is being clarified. A migration lawyer can help establish the visa chronology but cannot substitute for a Medicare eligibility decision or an insurer’s coverage determination.

What happens after a change, refusal or review?

A visa decision, departure from Australia or change in the permanent application can affect entitlements. Services Australia has specific guidance for failed permanent-residence applications and review situations. Notify the relevant authority and obtain current advice rather than assuming coverage continues indefinitely.

Likewise, a school should receive accurate status information where required. Keep immigration and service deadlines in separate calendars. A pending review may have different consequences for lawful stay, Medicare and school fees; do not collapse them into a single statement that the child is allowed to remain. Each issue deserves a documented answer based on the actual circumstances.

Department fees and the total cost of a child visa matter

The Department’s standard base application charge, checked on 29 September 2026 against Schedule 1 of the Migration Regulations, is AUD 4,040 for subclasses 101, 802, 102 and 445. For Orphan Relative subclasses 117 and 837, the standard base charge is AUD 2,475. These are government charges, not Emigrate Lawyers’ professional fees. The charge applicable when a valid application is made must be checked before payment.

Do not assume a child pays an additional-applicant rate merely because they are young. A child who makes their own primary application generally attracts the base charge. Siblings normally require separate Child Visa applications. Additional-applicant charges concern eligible people properly included in an application, such as an applicant’s own dependent child.

      Cost componentWhat to budget for
Government chargeStandard base fee above; check concessions and any eligible additional applicants.
Evidence and checksTranslations, police certificates where required, panel medical examinations and document retrieval.
Professional assistanceAn agreed legal scope and written fee quote, with GST treatment and disbursements identified.
Complex issuesForeign-law advice, court proceedings, specialist reports or review work may need a separate scope.

Eligible Pacific-regional passport holders can receive lower charges: the relevant Schedule 1 categories currently provide a base of AUD 3,315 for the usual Child/Adoption/445 pathways and AUD 2,030 for Orphan Relative applicants. Specific welfare-authority-supported onshore applications also have special rules. Eligibility, not financial hardship alone, determines the concession. Ask for a calculation for the actual applicant rather than relying on a generic fee screenshot. Check Home Affairs visa pricing.

Processing times: what the Department’s figures mean

The Home Affairs processing tool reports how long recently decided applications took. It does not reserve a decision date for your child, identify the case officer, or give a different service standard for each Australian city. The official processing-time guide should be checked for the exact subclass before making travel or school commitments.

At our 29 September 2026 check, the tool displayed 21 months for 50% and 30 months for 90% of Subclass 802 applications. These historical percentiles are not a minimum wait, a guarantee, or figures that can be transferred to another subclass. The tool showed an update date of 4 September 2026. An application outside the published range warrants a careful status check; it does not automatically establish an error or a right to immediate approval.

Keep the acknowledgement, payment evidence, application reference and copies of everything submitted. Monitor Department correspondence and update changed passports, addresses and relevant family circumstances. A targeted enquiry should explain what is outstanding and provide evidence of any urgent circumstances. Repeated identical emails, a school start date or payment of a higher legal fee do not create a guaranteed fast-track service.

Case example: a child on a temporary visa with a lodged permanent application

Illustrative case example: This is a hypothetical scenario to explain the legal issues, not a reported client result.

A child enters Australia on a temporary visa and has an eligible permanent Child Visa application pending. The parent is a permanent resident and wants to enrol the child in Medicare and school. The family prepares identity, visa, application and parent-status evidence for Services Australia and separately asks the school authority about admission and tuition.

The school offer does not establish Medicare eligibility, and Medicare enrolment does not alter the child’s visa conditions. The example shows why the family needs three coordinated checks rather than one assumed entitlement.

      The Emigrate Lawyers method

Our approach starts with the legal question that could decide the matter. For this article’s scenario, that means separating immigration status, Medicare eligibility and school arrangements so the family does not rely on the wrong approval. The file should explain why the evidence meets the relevant rule, rather than leave the decision-maker to infer the answer from a large collection of documents.

      1. Map the family and status history. Identify the applicant, proposed sponsor, parental responsibility, previous applications and relevant dates.
      2. Test the pathway before paying. Check the subclass, location, application validity, sponsorship and any exception that must be established.
      3. Build an evidence plan. Separate documents already available from material that needs translation, independent verification or specialist advice.
      4. Prepare a consistent application. Reconcile forms, supporting statements and earlier immigration records, explaining genuine discrepancies.
      5. Manage the period after lodgement. Track requests, changing circumstances, visa conditions and any time-sensitive response.

Emigrate Lawyers is based at Suite 807, 365 Little Collins Street, Melbourne VIC 3000 and assists clients throughout Australia and overseas through a paperless practice. Remote service does not remove a requirement to attend a medical examination, biometrics appointment or court process where one is needed. We explain the agreed work and professional fees before that work begins; no lawyer can guarantee a visa grant or Department processing speed.

      Frequently asked questions

Does my child’s 802 application guarantee Medicare?

The child must meet Services Australia eligibility and evidence requirements, including residence and an applicable additional qualifying condition. Confirm enrolment and the effective date.

Can an offshore 101 applicant use Medicare overseas?

Medicare eligibility and services are tied to the relevant residence and program rules. A pending Australian visa does not provide general overseas healthcare coverage.

Is 445 grant the last step for Medicare planning?

No. Home Affairs identifies the subsequent application to add the child to the parent’s permanent Partner Visa as important. Keep proof of that step and confirm eligibility.

Are public schools free for every Child Visa applicant?

Do not assume so. Fees and admission depend on the applicable education rules and the child’s actual visa status. Obtain a current assessment from the school authority.

Can a school letter remove a visa study restriction?

No. A school’s admission decision does not override a visa condition. The immigration position needs separate advice.
