Indian Student Visa Refused in Australia: ART Review and Written Evidence in 2026
Updated September 2026. Indian students who receive an onshore Australian Student Visa refusal may have a right to seek merits review at the Administrative Review Tribunal (ART). The refusal letter is critical because it identifies whether review rights exist and the deadline.

The 2026 change: most student reviews are now decided without a hearing
From 1 June 2026, the ART must decide most Student Visa refusal reviews without holding an oral hearing, except in limited circumstances. This makes the written evidence and legal submissions especially important.
What should an Indian student do immediately after refusal?
- Read the refusal decision carefully.
- Check the ART deadline.
- Check VEVO and any Bridging Visa status.
- Preserve academic, financial and enrolment evidence.
- Prepare a written response to the actual refusal reasons rather than repeating the original application.
Common refusal issues for Indian students
The refusal reason varies by case. Common issues can include:
- Genuine Student concerns;
- course progression or repeated course changes;
- financial capacity;
- English evidence;
- inconsistent study or employment history;
- weak explanation of why the course is appropriate; and
- information that does not match earlier visa applications.
What evidence may be important at ART?
- current enrolment and academic progress;
- transcripts and completion evidence;
- Indian and Australian employment history;
- financial records and source-of-funds evidence;
- family and career circumstances in India;
- evidence explaining course changes or study gaps; and
- a detailed written submission addressing the Department’s findings.
Does an ART application automatically let you stay in Australia?
The applicant’s lawful status depends on the visa history and whether a valid review is lodged in time. Bridging Visa conditions, work rights and travel rights should be checked individually.
Can you lodge another Student Visa while the ART review is pending?
Section 48 of the Migration Act may restrict further onshore visa applications after a refusal where the applicant does not hold a substantive visa. A Student Visa is not generally one of the visa classes prescribed for an onshore application by a person affected by section 48.
