Partner Visa Sponsor Becomes an Australian Citizen After Lodgement: What Changes?
If a Partner Visa sponsor becomes an Australian citizen after the application is lodged, that change does not normally damage the application. Australian citizens, Australian permanent residents and eligible New Zealand citizens are all recognised sponsor categories for the standard Partner Visa program.
The important point is that the relationship and sponsorship must continue to satisfy the relevant criteria when Home Affairs decides the visa. If the sponsor moves from permanent residence or eligible New Zealand citizen status to Australian citizenship, they remain within an eligible sponsor category.
Does the Partner Visa need to be lodged again?
No. A sponsor becoming an Australian citizen does not ordinarily require a new 820/801 or 309/100 application. The underlying relationship has not changed merely because the sponsor’s immigration or citizenship status has improved.
Should Home Affairs be told about the citizenship grant?
It is sensible to update the application with the sponsor’s new status and supporting evidence, particularly if the original sponsorship showed the sponsor as a permanent resident or eligible New Zealand citizen. Home Affairs requires applicants to notify relevant changes in circumstances before a visa application is finalised.
What evidence should be uploaded?
- Australian citizenship certificate, where available.
- Australian passport bio-data page once issued.
- An updated short statement if the sponsor’s status is referred to elsewhere in the application.
- Any updated identity details if the sponsor’s name has changed at the same time.
Does citizenship remove sponsorship limitations?
No. Becoming an Australian citizen does not erase a sponsor’s previous Partner Visa sponsorship history. The two-sponsorship limit, five-year rule and relevant compelling-circumstances provisions can still apply where the facts engage regulation 1.20J.
What if the sponsor was an eligible New Zealand citizen?
If the sponsor qualified as an eligible New Zealand citizen and later becomes an Australian citizen, the sponsor remains within an eligible category. The citizenship evidence should simply be added to the file so the Department has the sponsor’s current status.
Illustrative case example: permanent resident becomes a citizen during 309 processing
Composite example: An Australian permanent resident sponsored a spouse for a 309/100 application and became an Australian citizen 10 months later. The couple did not lodge a second sponsorship. Instead, the citizenship certificate and later Australian passport were uploaded to the existing application. The case continued under the same Partner Visa application with the sponsor’s updated status.
What does not change?
- The relationship must still be genuine and continuing.
- Health and character requirements still apply.
- Previous sponsorship limits do not disappear.
- The permanent 801/100 stage still follows the ordinary combined Partner Visa pathway.
Home Affairs confirms that the Partner Visa program is available to partners of Australian citizens, permanent residents and eligible New Zealand citizens. See our 820/801 hub and 309/100 hub.
General information only. Sponsor-status changes should be updated accurately and considered together with the sponsor’s full sponsorship history.
