PIC 4020 and Partner Visas: False Information, Bogus Documents and Refusal Risk
PIC 4020 can become a serious issue in an Australian Partner Visa application where Home Affairs believes a bogus document or materially false or misleading information has been provided. The criterion applies to key Partner Visa subclasses, including subclasses 820 and 309, and can also create exclusion periods that affect future visa applications.
The issue is not limited to fabricated documents. It can arise from inaccurate relationship dates, altered records, false statements, identity concerns, or information provided in earlier visa applications that conflicts with the Partner Visa case.
What is PIC 4020?
Public Interest Criterion 4020 is contained in Schedule 4 to the Migration Regulations 1994. Broadly, it requires that there be no evidence that the applicant gave, or caused to be given, a bogus document or information that is false or misleading in a material particular in relation to the current visa application or, in specified circumstances, a visa held in the 12 months before the application.
PIC 4020 also includes separate requirements relating to previous refusals under the criterion and satisfaction as to identity.
Current legislation can be checked on the Federal Register of Legislation.
Does PIC 4020 apply to Partner Visas?
Yes. The Migration Regulations require PIC 4020 to be satisfied in important Partner Visa pathways. For example, subclass 309 expressly requires PIC 4020, and subclass 820 contains PIC 4020 requirements for relevant applicants.
This means false or misleading information in a Partner Visa case can create a refusal risk separate from whether the relationship itself is genuine.
What counts as false or misleading information?
The legislation defines false or misleading information in a material particular as information that was false or misleading when given and was relevant to a matter the Minister could consider when deciding the visa application.
Examples in a Partner Visa context can include:
- incorrect relationship commencement dates;
- false claims about living together;
- misstated marriage or separation history;
- incorrect information about previous partners;
- false employment or financial information;
- incorrect travel history;
- misleading answers about previous visa refusals;
- false information about children or family composition;
- altered bank statements, leases or correspondence; or
- information that conflicts materially with earlier visa applications.
Not every minor error will necessarily engage PIC 4020. The significance of the information and the surrounding evidence matter.
What is a bogus document?
The Migration Act contains a specific definition of “bogus document”. It can include documents that are counterfeit, altered without authority, or obtained because of false or misleading statements.
Home Affairs also warns that providing altered, digitally manipulated or fabricated material can lead to refusal, cancellation, restrictions on future applications and possible legal consequences.
Can inconsistencies between visa applications cause a PIC 4020 problem?
Potentially.
Partner Visa applications often require Home Affairs to compare the new application with information already held from previous Student, Visitor, Skilled or other visa applications.
For example, if an earlier Student Visa application stated that the applicant was single at a time when the Partner Visa evidence now says the de facto relationship had already begun, Home Affairs may ask for an explanation.
The correct response is not to rewrite the history to make the forms match. The task is to establish what was true at each point in time and explain any genuine error or difference accurately.
What are the exclusion periods under PIC 4020?
PIC 4020 contains separate exclusion periods.
One part of the criterion examines whether the applicant or a member of the family unit has been refused a visa for failing the bogus-document or false-information requirement during the three-year period beginning before the current application.
A separate identity-related requirement looks back over a ten-year period where a visa was refused because the decision-maker was not satisfied as to identity.
The exact operation of these provisions should be assessed against the previous refusal and the current application.
Can PIC 4020 be waived?
There is a limited waiver power for specified parts of PIC 4020.
The current criterion permits the Minister to waive certain requirements where satisfied that either:
- compelling circumstances affecting the interests of Australia; or
- compassionate or compelling circumstances affecting the interests of an Australian citizen, Australian permanent resident or eligible New Zealand citizen
justify granting the visa.
The waiver is not automatic merely because the applicant has an Australian partner. The evidence must address the statutory waiver framework.
What evidence can matter in a PIC 4020 response?
Depending on the allegation, evidence may include:
- the original document said to be bogus;
- independent verification from the issuing body;
- metadata or document history;
- earlier visa applications;
- relationship chronology;
- bank, tenancy, employment or travel records;
- evidence showing a genuine mistake or misunderstanding;
- translation evidence;
- evidence about who prepared the earlier application;
- evidence of the Australian partner’s circumstances; and
- submissions addressing any available waiver.
What if a migration agent prepared the incorrect information?
The fact that a representative prepared or lodged material does not automatically remove the problem.
PIC 4020 can apply where the applicant gave or caused information or documents to be given. The factual circumstances around preparation, instructions, review and lodgement therefore need to be examined carefully.
Applicants should preserve emails, draft forms, messages and instructions showing what information was provided to the representative.
What if the incorrect information was accidental?
An innocent mistake is not the same as deliberate fraud, but intention is not the only issue.
The decision-maker will consider whether the information was actually false or misleading in a material particular and whether the relevant criterion is satisfied.
A credible explanation supported by contemporaneous evidence can be important.
Natural justice and PIC 4020
If Home Affairs is considering adverse information, the applicant may receive an invitation to comment or another procedural fairness opportunity.
The response should address:
- exactly what information or document is questioned;
- why Home Affairs considers it problematic;
- the correct factual position;
- supporting evidence;
- the legal operation of PIC 4020; and
- any waiver issue that is properly available.
A general statement that the applicant “did not mean to mislead” may not answer the legal issue.
PIC 4020 and Partner Visa relationship evidence
Partner Visa cases can be particularly exposed because relationship evidence spans years and often overlaps with earlier immigration applications.
Before lodgement, applicants should cross-check:
- relationship commencement date;
- dates of cohabitation;
- marriage date;
- previous relationship dates;
- addresses;
- travel dates;
- employment history;
- children and family details; and
- prior visa declarations.

Frequently asked questions
Does one wrong date automatically mean a Partner Visa will be refused under PIC 4020?
No. The context, materiality and evidence matter. But an unexplained inconsistency can become serious where it affects a matter relevant to the visa decision.
Can PIC 4020 apply because of an old visa application?
Potentially. PIC 4020 includes requirements relating to the current application, certain earlier visa information and previous refusals under the criterion.
Can a PIC 4020 refusal affect future visas?
Yes. The criterion contains exclusion periods that can affect later applications.
Is there a waiver for Partner Visa applicants?
There is a limited waiver power for specified parts of PIC 4020 where the statutory compelling or compassionate circumstances test is satisfied.
