International company boardroom discussing Australian market entry and overseas business sponsorship

Overseas Business Sponsorship can solve a specific market-entry or contractual deployment need without pretending the overseas company is already an Australian employer.
Cross-border sponsorship

The sponsor structure should match the commercial reason the overseas company is sending people to Australia.

An overseas business can potentially sponsor personnel where the current rules allow it, including to establish or assist in establishing an Australian operation or to fulfil contractual obligations in Australia.

Australian market entry

Deploy key personnel to establish or help establish an Australian business operation.

Contract delivery

Support Australian contractual obligations with overseas specialists or key personnel.

Group mobility

Coordinate overseas parent, Australian entity and employee arrangements so the sponsorship structure reflects the real business relationship.

Employer FAQs

Overseas sponsor questions.

General information only. Specific strategy depends on the employer, position, worker, timing and current migration law.

What is Overseas Business Sponsorship?
It is a sponsorship route available in appropriate cases for businesses operating outside Australia that need to sponsor personnel for certain Australian business establishment or contractual purposes.
Do we need an Australian company first?
Not necessarily in every case. The point of the overseas sponsorship pathway can be to support establishment of an Australian operation, but the exact structure and intended employment should be reviewed.
Can we later move to Standard Business Sponsorship in Australia?
Potentially. As the Australian operation develops, the group may need to revisit which entity should hold sponsor status and employ sponsored workers.
Is this the same as an intra-company transfer visa?
No. Australia does not have one universal intra-company transfer visa. Overseas business sponsorship is one corporate sponsorship mechanism that may support certain 482 arrangements.

Legal review: 25 September 2026. See Home Affairs employer sponsorship guidance and current Subclass 482 rules. Competitor market practice also commonly distinguishes Overseas Business Sponsorship from ordinary SBS.
