Executive team reviewing sponsorship or nomination refusal strategy

A refusal should trigger a legal and commercial decision: protect review rights first, then decide whether to challenge, rebuild or change pathway.
Decision response

A refused nomination can derail the employee visa even when the worker is otherwise eligible.

The first decision is not automatically ‘appeal’. Employers need to identify the refusal reasoning, review rights, deadline, effect on the associated visa and whether a corrected fresh application is legally and commercially better.

Nomination refusals

482, 186, 494 and other employer nomination decisions involving genuine position, occupation, salary, LMT or business evidence.

Sponsorship refusals

Standard Business Sponsorship and sponsor-status decisions involving operations, adverse information or eligibility.

ART & litigation strategy

Where review rights exist, prepare the employer evidence and legal case around the decision under review.

Corporate legal work

Treat the refusal notice as a legal problem map.

The refusal reason determines whether the issue is evidentiary, structural, legal or incapable of being cured on the same pathway.

What we handle

  • Refusal notice and reasons analysis
  • ART review-right and deadline advice
  • Nomination / visa consequence mapping
  • Relodgement versus review strategy
  • Genuine position submissions
  • Business capacity and structure evidence
  • Labour market testing and salary issues
  • Sponsor adverse-information matters
  • Evidence preparation for ART
  • Coordination with the sponsored worker’s separate visa case

Key risk points

  • Missing a strict review deadline
  • Assuming the employee visa can be approved after nomination refusal
  • Re-lodging without curing the actual refusal reason
  • Submitting new evidence that does not address the decision-maker’s concern
  • Failing to coordinate employer and employee review strategies
  • Treating a genuine-position refusal as a simple missing-document issue

Employer FAQs

Employer questions after a sponsorship or nomination refusal.

General information only. Specific advice depends on the business, sponsored workforce, decision or proposed transaction.

Can an employer appeal a nomination refusal?
Some employer sponsorship and nomination decisions can have merits review rights, depending on the decision and circumstances. The refusal notice and legislation should be checked immediately.
Are ART deadlines extendable?
Do not assume so. Migration review deadlines are strict and should be treated as urgent.
What happens to the worker’s visa if the nomination is refused?
The consequences depend on the visa application and procedural posture. In many employer-sponsored matters, refusal of the nomination prevents the related visa from succeeding unless the position changes through review or another pathway.
Is it better to appeal or lodge again?
That depends on the reason for refusal, available review rights, the ability to cure the defect, processing time and the worker’s immigration status. We assess both options rather than defaulting to one.
