HR and compliance team reviewing sponsorship obligations and employer migration risk

Sponsor compliance is an operating-system issue: payroll, duties, notifications and HR records need to remain aligned.
Corporate migration risk

Sponsor approval creates ongoing legal obligations.

Home Affairs states that sponsorship obligations can continue beyond the term of approval. Monitoring failures can lead to cancellation, bars, infringement notices, compliance notices, enforceable undertakings and civil penalties.

Proactive compliance audits

Review sponsor records, payroll, employment terms, duties, notifications and internal controls before a regulator does.

ABF / Home Affairs monitoring

Manage information requests, inspections, allegations and formal correspondence with a controlled legal strategy.

Corrective action & notices

Assess breaches, remediation, sponsor notifications and responses to potential cancellation or sanction action.

Corporate legal work

Build a defensible sponsor file for every worker.

Most employer problems arise because HR, payroll, operations and migration records diverge over time. Compliance should be designed into the employment lifecycle.

What we handle

  • Legally privileged internal sponsor audits
  • Sponsorship obligation reviews
  • Payroll and market salary consistency checks
  • Worker duties and occupation alignment
  • Sponsor notification reviews
  • Business restructure and ownership changes
  • ABF and Department monitoring responses
  • Compliance notices and enforceable undertakings
  • NOITTA / cancellation response strategy
  • Sponsored-worker offboarding protocols

Key risk points

  • Failure to notify reportable changes within required timeframes
  • Recovering prohibited sponsorship or recruitment costs from workers
  • Sponsored duties drifting away from the nominated role
  • Payroll falling below required terms
  • Missing records or inconsistent HR files
  • Corporate restructures creating a new employing entity without migration review

Employer FAQs

Sponsor compliance questions.

General information only. Specific advice depends on the business, sponsored workforce, decision or proposed transaction.

What can happen if a sponsor breaches its obligations?
Home Affairs identifies sanctions including sponsor cancellation, bars, infringement notices, court-imposed civil penalties, compliance notices and enforceable undertakings.
What changes must an employer notify?
Reportable events can include changes to business circumstances and sponsored-worker employment. The exact event and timeframe should be checked against current rules.
Can the worker repay our sponsorship costs?
There are restrictions on recovering or transferring certain sponsorship and recruitment costs. Employers should obtain advice before deducting or seeking repayment from a sponsored worker.
Should we audit before renewing sponsorship?
A pre-renewal compliance review can identify issues before the Department assesses a new sponsorship or accreditation application.
