Australian Citizenship Application Refused: ART Review and Evidence
Updated September 2026. A refusal of Australian citizenship is not the same as a visa refusal. Citizenship decisions are made under the Australian Citizenship Act and can involve identity, residence, good character, security, eligibility or other statutory requirements.

Can a citizenship refusal be reviewed by the ART?
The Administrative Review Tribunal states that it can review a range of citizenship decisions, including decisions refusing approval for a person to become an Australian citizen. Your decision letter should tell you whether the particular refusal is reviewable and whether you are entitled to apply.
Strict time limits apply.
Common reasons a citizenship application may be refused
Depending on the application type, issues can include:
- identity not being satisfactorily established;
- residence requirements;
- good character concerns;
- criminal proceedings or convictions;
- security-related restrictions;
- incorrect or incomplete information; and
- failure to satisfy a criterion applying to the particular citizenship pathway.
Good character refusals
Good character is not assessed simply by asking whether the applicant has a conviction. The Department may consider criminal conduct, dishonesty, compliance history and other relevant behaviour. If refusal is based on character, obtain the decision record and address the findings directly.
Identity refusals
Citizenship law places significant weight on identity. Where names, dates of birth, passports, birth records or earlier immigration documents are inconsistent, a coherent evidentiary explanation may be required.
What evidence should be prepared for ART review?
- the citizenship refusal decision;
- identity documents and explanations for discrepancies;
- travel and residence records;
- court and police documents where relevant;
- evidence of conduct since any offending;
- earlier visa and citizenship application records; and
- a written submission addressing each refusal reason.
Can you lodge a new citizenship application instead?
Sometimes a fresh application may be possible, but it may reproduce the same refusal if the underlying issue remains. In other cases, the law imposes periods during which an application cannot be approved. Review versus reapplication should therefore be assessed from the decision reasons.
Official guidance
The ART confirms that it can review certain Australian citizenship refusal or cancellation decisions.
