Bridging Visa During Federal Court Judicial Review: Work and Travel Rights

You have challenged a migration decision in the Federal Court and believe your bridging visa will protect you until the case ends. But judicial review does not itself guarantee unrestricted work, overseas travel or continuing visa status.

Legal context: This is general Australian migration information. Application validity, review rights, deadlines and relevant legislative instruments must be checked for your circumstances.

Judicial review is not a new substantive visa

Federal judicial review generally concerns legal error in a migration decision, not a fresh merits assessment of visa eligibility. Starting court proceedings does not automatically grant a substantive visa. Whether a person holds or can obtain a bridging visa depends on the applicable bridging visa criteria, procedural history and timing. Obtain all bridging visa grant notices and court filing documents before assuming the person is lawful.

Which bridging visa is actually in effect?

A person may have received more than one bridging visa grant over the course of an application, ART review and court proceedings. The latest grant notice does not always tell the full story without checking commencement and cessation provisions. Examine VEVO, each grant notice and the relationship between the underlying visa application and review. An old Bridging Visa A should not be treated as proof of current status.

Can you work during judicial review?

Work rights depend on the conditions attached to the bridging visa actually in effect. Some bridging visas carry work restrictions; others may permit work, subject to their terms. Commencing Federal Court proceedings does not automatically remove a no-work condition. If a change of conditions is available, the applicant must satisfy the applicable criteria and provide evidence rather than simply notifying the Department of employment.

Can you leave Australia and return?

A Bridging Visa A does not provide a travel facility and ordinarily ceases on departure. A Bridging Visa B may permit travel during an approved period where the applicant qualifies and receives a grant before leaving. The applicant should check whether the pending litigation affects eligibility or strategy and whether the proposed return date falls within the authorised period. Court proceedings do not independently grant permission to re-enter.

What if the Federal Court finds jurisdictional error?

The court’s orders must be read carefully. A successful judicial review may result in a decision being quashed and remitted for lawful reconsideration, but it does not necessarily grant the substantive visa. The status of the underlying application, tribunal matter and bridging visa requires separate assessment after judgment. Do not assume a court victory immediately restores all work or travel rights.

What happens if judicial review fails?

An unsuccessful proceeding can create urgent immigration-status questions, including bridging visa cessation, possible appeal deadlines and future application restrictions. Applicants should seek advice promptly rather than relying on an assumed grace period. The exact position depends on the visa, decision and statutory provisions. A fresh visa application may be restricted by section 48 or other rules.

Scenario: invited for a skilled visa during court proceedings

A former student in judicial review receives a subclass 189 invitation. Before applying or departing, the lawyer should assess section 48, the skilled visa’s application location rules, the bridging visa and court case. A Bridging Visa B may be relevant to travel, but it is not an exemption from visa application validity. The applicant needs a coordinated strategy, not separate assumptions from different visa processes.
