National Innovation Visa EOI: Invitation & 60-Day Rule

The National Innovation Visa EOI is one of the most strategically important stages of the Subclass 858 process because Home Affairs does not allow applicants to add information or documents after it is submitted.

An EOI is not the visa application. It is the mechanism through which the Department decides whom to invite to lodge a National Innovation Visa application.

For complete eligibility requirements, see our National Innovation Visa (Subclass 858) hub.

Is the NIV EOI submitted through SkillSelect?

No. The National Innovation Visa uses a dedicated Home Affairs EOI web form. It is separate from the SkillSelect EOI system used for points-tested skilled visas.

What documents are required with the NIV EOI?

Home Affairs currently requires:

  • passport bio-data page;
  • resume or CV; and
  • evidence of the applicant’s highest qualification.

Documents must be provided in English. If a document is in another language, an English translation must also be supplied.

Home Affairs states that it cannot access documents stored on cloud platforms. The accepted formats listed by the Department are PDF, JPG and PNG.

What extra documents apply for government-nominated candidates?

If the candidate is nominated by an expert Australian Government, State or Territory Government agency, the EOI must also include:

  • a completed Form 1000 with Part A completed by the nominating agency; and
  • a supporting statement from the agency explaining the nomination, expected contribution and relevant collaboration.

Can you update an NIV EOI after submission?

No. Home Affairs states that you cannot add information to the EOI after submission and cannot later provide more documents or update the information.

This is materially different from migration processes where an EOI can be edited over time. It means the decision to file should be deliberate.

How long does an NIV EOI remain active?

An EOI stays in the Department’s system for two years from submission. During that time, the Department may invite the candidate to apply.

If no invitation is received within two years, the EOI expires.

Should you submit multiple NIV EOIs?

Home Affairs says not to submit multiple EOIs unless there has been a significant change in circumstances.

If a candidate plans to submit a genuinely updated EOI, the Department recommends withdrawing previous EOIs.

How often are NIV invitations issued?

Home Affairs currently states that invitation rounds occur monthly.

The Department considers all submitted EOIs by reference to indicators of exceptional and outstanding achievement and the NIV program priority order.

Does an invitation mean Home Affairs has approved the case?

No. The Department expressly states that an invitation is not a pre-assessment of eligibility for grant.

The subsequent visa application is assessed on its merits and supporting evidence.

What happens when you are invited?

The invitation email includes a unique reference identifier and invitation code. It also identifies the achievement or achievements that formed the basis of the invitation.

The applicant must then provide evidence of those achievements with the visa application.

The 60-day rule

If invited, the applicant has 60 days from the date of invitation to complete and submit the Subclass 858 visa application.

Home Affairs states that it cannot extend this 60-day period.

An application lodged without an invitation or outside the invitation period will not be accepted.

What if the 60 days are missed?

The candidate must submit a new EOI to be considered for another invitation. There is no guarantee that another invitation will be issued.

For that reason, applicants should ideally prepare the likely visa-stage evidence before or while waiting for invitation rather than beginning the case from zero after the email arrives.

Does an NIV EOI give you a bridging visa?

No. An EOI is not a visa application and does not entitle the candidate to a bridging visa.

A person in Australia who needs to remain lawfully after their current visa expires must separately assess another visa option or depart before becoming unlawful.

Can you withdraw an EOI?

Yes. Home Affairs allows an EOI to be withdrawn before expiry or invitation. The Department’s current instructions require a withdrawal request to be sent from the email address used for the EOI and to include the candidate’s name, date of birth and EOI reference number.

What should be settled before filing the EOI?

At minimum, sophisticated candidates should have clarity on:

  • the precise area of exceptional achievement;
  • the current Direction 120 priority position;
  • the strongest achievements to claim;
  • objective supporting evidence;
  • the Australian contribution narrative;
  • the establishment pathway;
  • the likely Form 1000 nominator;
  • any age-related exceptional benefit issue.

Why legal review before the EOI can matter

The EOI is short compared with a full visa application, but its strategic importance is disproportionate because it becomes locked and determines the achievements on which an invitation may be based.
