What If Your Partner Visa Sponsor Moves Overseas While Your 820 Is Processing?
An Australian Partner Visa sponsor moving overseas while an onshore Subclass 820/801 application is processing does not automatically cancel the visa application. The key issues are whether the sponsor remains eligible, whether the relationship remains genuine and continuing, whether the couple is living together or not living permanently apart, and whether Home Affairs has been told about relevant changes.
This article deals specifically with a sponsor relocating overseas after an onshore Partner Visa has already been lodged. For the main pathway, see our Subclass 820/801 Partner Visa hub.
Does the sponsor have to stay physically in Australia?
There is no general rule that an approved Partner Visa sponsor must remain physically in Australia every day while the 820/801 application is pending. What matters is that the sponsorship remains in force and the relationship continues to meet the legal requirements.
The relationship still needs to be genuine and continuing
Home Affairs assesses whether the couple has a mutual commitment to a shared life, whether the relationship is genuine and continuing and whether the couple lives together or does not live permanently apart. Temporary separation because of work, study, family obligations or an overseas posting can be consistent with a genuine relationship, but the reason for living apart should be clear and supported by evidence.
What evidence should you keep if the sponsor relocates overseas?
- Evidence explaining why the sponsor moved overseas.
- Flight records and visits between the parties.
- Communication records showing regular contact.
- Ongoing financial arrangements or mutual support.
- Evidence of joint decision-making and future plans.
- Proof of plans to resume living together where relevant.
- Updated statutory declarations or relationship statements at the permanent stage.
Do you need to update Home Affairs?
Yes, if residential address or contact details change. Home Affairs allows applicants and sponsors to update contact details through ImmiAccount. The Department also requires applicants to notify changes in circumstances that are relevant to the application.
What if the move becomes permanent?
A permanent overseas relocation can require closer analysis. The issue is not the overseas address itself; it is whether the couple still genuinely intends a shared life and is not living separately and apart on a permanent basis. If the move reflects relationship breakdown rather than temporary separation, the Department should be notified and the relationship-cessation provisions may need to be considered.
What happens at the 801 stage?
Home Affairs requires most 801 applicants to continue to be the spouse or de facto partner of the same sponsor. The permanent-stage evidence specifically asks about living arrangements, time apart, financial commitments, household arrangements, social aspects, commitment and future plans. Evidence that the parties stay in touch while apart can be relevant.
Illustrative case example: sponsor accepts a two-year overseas posting
Composite example: An Australian sponsor accepted a two-year employment posting in Singapore after the couple lodged an 820/801 application. The applicant remained in Melbourne due to work and family commitments. Instead of treating the separate addresses as a problem to hide, the couple documented the employment reason for the move, shared finances, daily communication, regular visits and their plan to resume living together in Australia. The evidence explained why the parties were apart without suggesting the relationship had ended.
Home Affairs requires applicants to update address and contact details through ImmiAccount and confirms that 801 applicants should show they remain in a genuine and ongoing relationship with the sponsor. See our 820/801 Partner Visa lawyers page.
General information only. Overseas relocation should be assessed in the context of the couple’s actual relationship and future plans.
