Before a final decision

A Department notice deserves a considered response.

A request for information, a procedural fairness letter and a proposed cancellation notice serve different purposes. A section 56 request may seek further documents; a section 57 invitation concerns certain adverse information. A Notice of Intention to Consider Cancellation raises a different question again.

We identify what the Department is asking, the applicable response period and the evidence needed. That can include addressing inconsistent information, explaining a change in circumstances, obtaining independent records and preparing submissions that engage with the actual concerns.

Where character issues arise, the relevant section 501 process and any revocation or review pathway require a separate assessment. Do not assume that an ordinary cancellation response or ART deadline applies.

Understand your options

Review, respond or consider another pathway?

There is no single appeal process for every Australian visa decision. We assess the legal route before recommending the work.

ART merits review

The Administrative Review Tribunal can review specified migration decisions. We check reviewability, the correct applicant, lodgement requirements and the matters the Tribunal can consider.

Representation may include reviewing the Department file, organising relevant evidence and preparing submissions or a hearing, depending on the Tribunal’s process.

ART appeals and reviews

Judicial review

Court proceedings concern jurisdictional error. They do not provide a fresh assessment of whether your visa should be granted, and the Court cannot grant the visa.

We assess whether there is an arguable legal error, the applicable filing period and the practical implications, including costs. Further proceedings are separately scoped.

Court review of migration decisions

Another application

In some cases a fresh application may be considered. Its validity, eligibility requirements and the original refusal reasons must all be examined.

Section 48 and other application restrictions can affect onshore options. A new application does not preserve an existing review deadline or automatically resolve your immigration status.

How Emigrate Lawyers helps

From the decision letter to a practical legal strategy.

01 / ASSESS

Read the decision

We examine the reasons, notification history, relevant criteria, review rights and immediate status issues. Tell us at the outset about detention, visa expiry or any imminent deadline.

02 / PLAN

Explain the options

We identify the available process, material risks and evidence gaps. You receive a proposed scope and fee terms so you understand the work before engaging us.

03 / PREPARE

Build the response

Once retained, we organise the relevant records and prepare the agreed application, evidence or submissions. We address the specific reasons and legal questions in your case.

04 / REPRESENT

Manage the next stage

We manage agreed correspondence, directions and preparation for the relevant process. Later hearings, new decisions or court proceedings depend on the retainer and any further agreement.

Already lodged an ART review? We can assess a potential takeover. Include the current directions, hearing details or written-submission deadline with the refusal record so we can evaluate the remaining work and available time.

Prepare for your assessment

Bring the full decision, not just the outcome.

A refusal notification may explain review rights while a separate decision record explains the reasons. Both can be important. Keep the original email and attachments so the notification history can be checked.

  • The complete refusal, cancellation or proposed cancellation documents.
  • The date and method of notification, including emails sent to a previous representative.
  • Your passport details, visa grant notices and current visa information.
  • The original application and material already supplied, where available.
  • Any ART correspondence, directions, submissions and hearing information.
  • A short timeline of important events and any new evidence.
Arrange an assessment of your decision

Your position in Australia

Check lawful status, work and travel separately.

A refusal and a cancellation can have different effects on an existing visa. The timing of any bridging visa cessation and the consequences of a review must be checked against your actual circumstances.

Do not assume that lodging a review automatically gives you work rights or permission to leave and re-enter Australia. Travel may affect your visa position or the review itself.

Detention or removal concerns: identify these immediately when contacting us. They may require a different and especially urgent assessment.

Professional fees & engagement

Know the scope before you commit.

A short refusal assessment, a full ART review and a court proceeding involve different work. We explain the proposed service, the documents required and the fee terms before engagement.

Our advice can also help you decide whether further proceedings are justified. The appropriate strategy depends on the legal issues, available evidence and your instructions.

Request consultation and fee information

What your quote should explain

  • The stage and tasks included in our professional fees.
  • Whether evidence preparation, written submissions and a hearing are covered.
  • GST and any separate ART or court application fees.
  • Any anticipated counsel, interpreter or independent report costs.
  • What would require an additional agreement.

Government charges and eligibility for any reduction depend on the process and current rules. We confirm the applicable position for your matter rather than assuming one fee applies to all reviews.

Visa refusal & cancellation FAQs

Start with the questions that matter.

What is the difference between a visa refusal and a visa cancellation?
A refusal means an application has not resulted in a visa grant. A cancellation affects a visa that has already been granted. The reasons, consequences and available response can differ. We assess the particular decision rather than assuming the same review pathway applies to both.
Can every Australian visa refusal or cancellation be appealed?
No. Review rights depend on the decision, the legal power used, the applicant’s circumstances and who is entitled to apply. A sponsor or nominator may be the correct review applicant in some matters. Read the notification and obtain advice promptly; an unfavourable decision alone does not establish ART jurisdiction.
How long do I have to apply for an ART review?
Check the exact decision notification immediately. Time limits vary across migration, protection, character and detention matters, and notification rules can affect the calculation. The ART cannot extend the statutory application period for migration and protection reviews. Do not assume you have 28 days or wait for a consultation before taking urgent steps to protect a deadline.
Can I stay and work in Australia while a review is pending?
That depends on your visa status, the decision, whether a valid review has been lodged and the conditions of any bridging visa. Applying for review does not itself establish a universal right to remain, work or travel. Have your current visa and any cessation date checked separately.
Should I lodge a new visa application instead of seeking review?
A new application may be possible in some cases, but the reason for refusal must be addressed and application restrictions may apply. Section 48, protection-related restrictions, character provisions and visa-specific criteria can affect validity or eligibility. Reapplying does not extend an existing review deadline.
Can you take over an ART matter that is already lodged?
We can assess an existing review, including the decision, material already filed, upcoming directions and any hearing or written-submission timetable. Acceptance depends on the circumstances, available time and agreed scope. Send the decision record and current ART correspondence when arranging the assessment.
What is the difference between ART review and judicial review?
ART merits review considers a reviewable decision within the Tribunal’s legal powers. Judicial review considers whether a decision is affected by jurisdictional error. The Court does not conduct a fresh merits assessment or grant a visa. We assess the appropriate process before recommending further proceedings.
Can you help with a Notice of Intention to Consider Cancellation?
Yes. We can review the proposed grounds, the response deadline and available evidence, then prepare submissions within the agreed retainer. A notice proposing cancellation is different from a final cancellation decision. Responding early may be an important opportunity to address the Department’s concerns.
How much does a visa refusal or cancellation lawyer cost?
Professional fees depend on the decision, evidence, urgency and work required. We explain the proposed scope and fee terms before engagement. ART or court filing fees, counsel, interpreters, reports and other disbursements are separate where applicable. Any later review or court stage needs its own agreed scope.
Do you assist clients outside Melbourne?
Yes. Emigrate Lawyers is based in Melbourne and provides immigration advice and representation to clients across Australia, including Sydney, Brisbane, Perth, Adelaide and regional areas. We can also assess enquiries from overseas where an Australian visa decision affects the applicant or an Australian sponsor.
Does contacting Emigrate Lawyers protect my review deadline?
No. An enquiry, consultation request or document sent to us does not lodge an ART or court application, extend a deadline or confirm that we act for you. If a deadline is approaching, call 1300 807 134 and identify it immediately. Representation begins only when the engagement is agreed.
