Breaking: Protection Visa Applicants Lose Access to New Bridging Visa B From 1 November 2026

Breaking migration news · 4 November 2026

Australia has restricted access to Bridging Visa B for people with pending permanent Protection visa matters, changing overseas travel planning for subclass 866 applicants and people challenging protection decisions. The new rules commenced on 1 November 2026.

The change affects applications made to Home Affairs and matters awaiting merits review or judicial review. However, the transition matters: Home Affairs says BVB applications lodged before 1 November will continue to be processed. Existing visa holders should check their individual grant rather than assume a news headline has cancelled their travel permission.

Before booking or departing: A pending protection claim, an ART case or court proceedings do not provide permission to return to Australia. Check your visa, the BVB application date and any existing travel facility with a lawyer before making a decision that could leave you overseas.

What changed on 1 November 2026?

The Migration Amendment (2026 Measures No. 1) Regulations 2026 introduced protection-related exclusions into both the application requirements and grant criteria for a Bridging B visa, subclass 020.

For new BVB applications, an unresolved Protection (Class XA) visa application can prevent eligibility. The exclusion also covers ongoing judicial review proceedings relating to that application, including appeals. Home Affairs confirms that people awaiting protection outcomes with the Department, ART or a court cannot obtain a new BVB under the changed arrangements.

This is a legal eligibility change. A persuasive travel itinerary cannot overcome a statutory restriction. Readers should therefore distinguish a refusal because travel reasons were insufficient from a situation where the person cannot make a valid BVB application at all.

What was the rule before?

Previously, some protection applicants could seek a BVB while holding an eligible bridging visa and satisfying the relevant criteria, including substantial reasons for travel. Protection applicants did not have an automatic entitlement, and people on Bridging Visa C or E could not simply assume they qualified.

The practical difference is significant. Earlier advice might have focused on documenting a funeral, family illness or another substantial reason. For a new application caught by the November restriction, the first question is now whether the protection-related exclusion applies.

A friend’s earlier BVB grant is therefore an unreliable guide. Their visa history, application date and legal position may differ from yours.

Who is affected: Home Affairs, ART and court cases

The restriction is not confined to somebody who lodged a protection application recently. A longstanding application can be affected when the person seeks a new BVB after commencement.

It is relevant to people awaiting an initial subclass 866 decision, people pursuing ART review of a protection refusal, and people undertaking judicial review of a protection-related decision. Court proceedings do not create a travel entitlement.

If your case has several stages, prepare a clear chronology: protection lodgement, Department decision, Tribunal application and outcome, court filing, and any appeal. Your lawyer needs that history to identify which legal proceedings remain unresolved.

What if you applied for a BVB before 1 November?

The transitional provision applies the bridging visa amendments to visa applications made on or after commencement. Home Affairs expressly says it will continue processing BVB applications lodged before 1 November.

That preserves assessment under the earlier rules; it does not guarantee approval. Keep the lodgement acknowledgement, payment record and any Department correspondence. Preparing documents or starting a form is different from successfully lodging an application.

If an older application remains undecided, obtain advice before withdrawing it or submitting a replacement. A replacement may fall under the new rules. Do not depart merely because you lodged before the deadline: a pending BVB application is not permission to travel.

Already hold a BVB? Check the travel facility

The amendments do not themselves cancel every BVB previously granted. An existing holder needs to establish whether the visa remains valid and whether its travel facility covers the proposed departure and return.

A BVB’s permission to stay and its permission to travel are distinct. A person may remain lawfully in Australia after the travel facility ends, yet have no ability to use that visa to return from overseas.

Home Affairs warns that affected protection applicants whose BVB travel facility has expired cannot apply for another BVB or request travel permission. Do not describe this as a routine extension: further travel ordinarily requires a new BVB application, and the new exclusion may prevent it.

Check the grant notice against VEVO. If you are already overseas, seek urgent advice before the last permitted return date. Airline changes do not extend a visa.

Are funerals, emergencies or third-country trips exempt?

The amended BVB provisions do not contain a general compassionate exception to the protection exclusion. A family emergency is serious, but urgency does not by itself restore eligibility.

The restriction also concerns access to a BVB, rather than travel to one particular destination. Planning to visit a third country instead of the country of claimed persecution does not remove that eligibility issue.

Consider this example: a protection applicant on a BVA wants to meet an ill parent in another country. The destination may raise different protection-evidence questions from returning home, but it does not create an exemption from the new BVB rules.

Obtain advice before paying an adviser who promises an “urgent BVB” without checking the protection history and commencement rules.

Does a partner or skilled visa application provide a workaround?

The legislation creates both a requirement for a qualifying non-protection visa matter and a separate protection-related exclusion. Having another visa application pending does not, by itself, overcome the exclusion.

For example, somebody with pending protection and partner visa applications should not assume that selecting the partner application when requesting a BVB resolves the problem. The decision-maker must consider the person’s actual circumstances against all applicable requirements.

Nor should a person withdraw a protection claim simply to pursue travel. Withdrawal can affect lawful status, future application options and protection strategy. Any remaining court proceedings also need separate assessment. A lawyer should consider the whole position before recommending an irreversible step.

What happens if you leave on a BVA, BVC or BVE?

Home Affairs explains that other bridging visas do not provide the BVB’s overseas travel and return facility. A bridging visa other than a BVB ceases when the holder departs while it is in effect.

A passport, return ticket or pending Australian application is not a substitute for a visa allowing entry. Likewise, being able to exit Australia does not establish a right to return.

Where another substantive visa remains valid, its travel rights require separate checking. The BVB amendment should not be described as a universal legal ban on departure. The immediate issue is the loss of access to a particular return pathway.

Our Bridging Visa B guide explains the general visa framework, while our protection bridging visa and work-rights guide addresses lawful stay and employment.

Travelling after a Protection visa grant is different

A person already granted a subclass 866 visa has a different legal position from an applicant relying on a bridging visa. Their travel planning requires consideration of the permanent visa’s travel facility, passport or travel document, and applicable conditions.

Home Affairs requires permission before a protection visa holder travels to the country from which protection was sought. Condition 8559 is particularly relevant. Do not confuse that permission process with obtaining a BVB while an application remains pending.

Travel can also raise questions about continuing protection needs. Explain the purpose and circumstances honestly. Family pressure, an emergency and an ordinary holiday can involve very different evidence, but none should be concealed.

Why has the Government made this change?

The explanatory statement presents the measure as part of the Government’s response to misuse of the permanent protection system. It aims to reduce incentives to use protection applications to maintain temporary residence and international travel flexibility.

That policy explanation should not be treated as a finding that every affected applicant has made a false claim. Genuine applicants can also face difficult family and medical circumstances. The practical task is to understand the changed legal position without making assumptions about an individual’s credibility.

Related ART fees and Bridging Visa E conditions

The same instrument changes protection review fees and restores discretion to impose conditions 8564 and 8566 on certain BVE grants. Those conditions concern criminal conduct and compliance with a signed Code of Behaviour; they are not automatically added to every existing BVE.

The ART has announced an upfront protection review fee of $1,863.50 for most affected reviews, with specified exemptions and refunds. Cases spanning commencement require attention to the legislative saving provisions as well as Tribunal guidance.

Read our separate ART protection review fee update for the payment rules. Paying a Tribunal fee does not create BVB eligibility, and a travel problem does not pause a review deadline.

What should protection applicants do now?

  1. Identify your current visa. Obtain the grant notice and current VEVO result.
  2. Check dates. Record any BVB lodgement date and the exact travel facility expiry.
  3. Map your case. List pending Department, ART and court proceedings.
  4. Preserve documents. Keep acknowledgements, orders and Department messages together.
  5. Obtain advice before departure. Discuss emergencies promptly, before making non-refundable arrangements.

Tell your lawyer about every pending visa application and any travel already booked. If you are overseas, provide your location and intended return date immediately. Complete information allows the advice to address the real problem.

Protection visa Bridging Visa B FAQs

Can I get a new BVB while my protection appeal is pending?

For applications from 1 November 2026, the protection exclusion covers unresolved protection matters, including relevant ART and judicial review proceedings.

Does the change cancel an existing BVB?

Not automatically. Check the visa’s continuing validity, travel dates and conditions before relying on an earlier grant.

Can I renew an expired BVB travel facility?

Affected applicants cannot assume another BVB is available. Home Affairs says an expired facility cannot be replaced through a further BVB or travel-permission request.

Can an urgent request overcome the restriction?

Urgency does not itself remove the statutory exclusion. Seek advice about your actual visa position before travelling.
