Offshore Partner Visa 309 Refused: Who Can Apply for Review?

Australian Visa Refusal hub: For the complete refusal pathway, including decision-letter analysis, ART review rights, strict deadlines, reapplication and judicial review, see our Australian Visa Refusal guide.

After an offshore partner visa refusal, who can apply for review of a 309 decision is a threshold question. The visa applicant and the person entitled to seek review may not be the same person. Do not lodge in a name selected simply because that person completed the original visa application.

Have the refusal and review information checked promptly. The sponsor’s role, the decision type and the relevant legal requirements need assessment before anyone assumes they can make a valid review application.

Distinguish three different roles

  • Visa applicant: the person who applied for the visa.
  • Sponsor: the person who supported the partner visa application in that capacity.
  • Review applicant: the person legally entitled to ask the Tribunal to review the particular decision.

An adviser or lawyer assisting with paperwork is another distinct role. Representation does not itself make that person the review applicant. Keep each person’s name, date of birth and role clear in the documents you provide.

Read the review section of the refusal notice

The ART migration review application form and guidance distinguishes visa applicants from review applicants and directs readers to the notification letter for who may apply. Use the complete decision rather than an extract forwarded without its review information.

For an offshore partner refusal, have the sponsor’s possible review entitlement checked specifically. Do not assume either that the overseas applicant can always apply personally or that every sponsor can review every kind of refusal. If the letter is unclear, resolve that issue urgently with legal advice.

Prepare an identity and role checklist

Provide the lodged visa application, sponsorship records, refusal notice and original notification message. Add the current contact details and location of each person. Identify any name changes or differences in spelling across passports and application records.

Include details of secondary applicants and any separate decisions. A family file can contain several people and more than one procedural question. Do not assume the treatment of the primary applicant automatically answers every dependant’s position.

Questions for the initial assessment

  1. Which decision is being considered for review?
  2. What provision gives a review entitlement, if any?
  3. Who is the correct review applicant?
  4. Are any location or other eligibility conditions relevant?
  5. What deadline and valid-lodgement requirements apply?

Keep entitlement separate from the merits

A strong relationship history does not, by itself, establish who can lodge. Resolve the procedural starting point while preserving evidence for the substantive case. You can organise the relationship file in parallel without delaying urgent advice.

Once the correct route is established, map the refusal findings to the available evidence. If the concern relates to a particular period apart, identify records from that period. If another criterion caused the refusal, a larger relationship bundle may not address it.

Communicate clearly between the couple and representative

Agree who will receive correspondence and who is responsible for providing documents. Keep copies of the final application and submission receipt. Where people are in different time zones, allow for practical delays without assuming those delays affect the legal deadline.

Tell your representative promptly about relevant changes, including contact details or relationship circumstances. Keep the original facts and later developments distinguishable. Do not rewrite an earlier statement to make it appear that a later event had already happened.

What if the review applicant was entered incorrectly?

Seek advice immediately with a copy of exactly what was lodged and any acknowledgement. Do not assume an online form can simply be corrected after a deadline or that lodging a second application will resolve the problem. The available response depends on the circumstances.
