482 Nomination Refused: What Happens to the Visa Application?

A 482 nomination refusal can have direct consequences for the related Skills in Demand visa application. The sponsor, nomination and visa are legally connected but separate decisions. Employers and workers should therefore review the nomination refusal immediately rather than wait for the visa application to be decided.

Why the nomination matters

A subclass 482 visa relies on an eligible nomination under the relevant stream. If the nomination is refused and there is no valid approved nomination supporting the visa application, the visa may also be unable to succeed.

Read the refusal reason, not just the outcome

Nomination refusals can involve issues such as:

  • whether the position is genuine;
  • occupation classification and duties;
  • salary and employment conditions;
  • labour market testing;
  • business operations and capacity;
  • adverse information about the sponsor; or
  • failure to provide requested evidence.

The strategy should address the actual finding rather than simply lodge another nomination with the same documents.

Check ART review rights immediately

The refusal notice should state whether the decision is reviewable, who is entitled to apply and the deadline. In employer-sponsored matters, the employer and visa applicant can have different procedural positions.

A nomination review deadline should not be missed while waiting for the visa application to be refused.

Can the employer lodge a new nomination?

Sometimes a fresh nomination may be considered. Whether that is sensible depends on the refusal reason, current visa application, worker’s status and whether the defect can genuinely be corrected.

A new nomination does not automatically attach itself to every pending visa application. Obtain advice on the procedural interaction before relodging.

What happens to the worker’s bridging visa?

If the worker applied onshore, check the bridging visa grant notice and current VEVO record. The effect of any later visa refusal and review application should be assessed separately.

Do not cancel an existing substantive visa merely because a 482 application is pending.

What if the position has changed?

If the employer has changed the role, location, salary or duties since nomination, a new nomination strategy may be required. Trying to defend an outdated position can be less useful than addressing the current employment reality.

Genuine position evidence

Where genuineness is in issue, useful material can include organisational charts, business contracts, workforce records, financial documents, role-specific evidence and an explanation of how the position fits the business.

Labour market testing problems

If the refusal concerns advertising, review the dates, platforms, advertisement content and any exemption relied on. Labour market testing rules are technical and timing errors cannot always be repaired retrospectively.

Visa refusal and nomination refusal are separate decisions

If the visa is later refused, read that decision independently. There may be separate review rights and deadlines.
