491 to 820 Partner Visa: The Three-Year Application Restriction Couples Must Check
Holding a 491 and forming a genuine relationship with an Australian partner does not automatically make an 820 application available straight away. Home Affairs identifies a three-year restriction relevant to applying for an 820 from the 491 pathway. This is an application-validity issue, not just another item in the relationship evidence checklist.
This article focuses on that restriction and continuing regional obligations. For the complete partner framework, see our 820/801 page.
Key points before you start
- The 491 pathway has a three-year restriction relevant to an 820 application.
- Marriage and registration do not automatically remove an application bar.
- Regional conditions continue while the relevant visa is in effect.
A genuine relationship and a valid application are separate questions
Sections 5F and 5CB of the Migration Act 1958 address the relationship definitions. Section 46 and the relevant Schedule 1 requirements concern whether a visa application is valid. A couple can meet a relationship definition while still encountering an application restriction.
Home Affairs’ 491 guidance states that unless the holder has held the 491 for three years, they cannot make a valid application for certain listed visas, including an 820. The precise Schedule 1 wording, grant history and circumstances need to be checked before selecting a date.
A proposed move should also be assessed using the interstate registration and address guide. If another visa application is pending, see how grant order can affect the visa in effect; neither issue is resolved merely by proving the relationship start date.
Do not assume that paying a fee online proves the application is valid. Nor should a relationship certificate be treated as a device that removes an unrelated application bar.
Calculate from the correct visa history
Obtain the grant notice and a reliable history of visas held. Identify the relevant grant and period, rather than calculating from an expression of interest, state nomination or arrival date without checking the rule.
Where there have been multiple regional visas, changes of status, earlier grants or unusual circumstances, seek advice on the exact legal provision. A simple three-year anniversary in a diary may not capture every issue.
Ask for the application-validity conclusion to be explained separately from the assessment of relationship evidence. That avoids a large, expensive evidence exercise proceeding on an assumed filing date that has not been checked.
Marriage and registration do not automatically remove the restriction
Marriage can change whether the relationship is assessed under the spouse framework. Qualifying registration can affect the usual de facto duration requirement under regulation 2.03A. Neither event should be assumed to override the 491-related application restriction.
This distinction is especially important for newly married couples who expect marriage to unlock every visa option immediately. It is an important legal event, but immigration law can attach separate conditions to the application pathway.
If advice proposes an exception or alternative strategy, ask which provision supports it and how the facts meet that provision. A confident statement that “partners are always exempt” is not a substitute for the actual law.
Regional conditions continue while the 491 is in effect
Read the grant notice and VEVO, including condition 8579 where imposed and any other relevant conditions. Home Affairs publishes the requirements for living, working and studying in the specified regional areas and associated notification obligations.
Contemplating an 820 does not remove those obligations. Lodgement itself should not be treated as permission to relocate to a non-regional area or abandon compliance with the visa in effect.
If the Australian partner lives elsewhere, plan the relationship and residence arrangements with both sets of facts in view. Explain genuine periods apart and practical decisions. Do not maintain a paper regional address while actually living somewhere inconsistent with the visa conditions.
Do not improvise an offshore workaround
Leaving Australia and applying for another subclass can introduce different application, grant, return and status questions. It should not be presented as an automatic solution to an onshore restriction. The visa history and any relevant criteria need individual assessment.
Likewise, lodging another application does not itself guarantee a bridging arrangement or preserve permission to return. Check travel before booking, particularly where work and regional commitments continue.
The right assessment compares legally available options and their practical effects. It does not begin by promising the couple that one flight removes every difficulty.
Prepare useful evidence while the timeline is assessed
Keep relationship records current and ordinary: household arrangements, financial cooperation, contact during separation, social recognition and shared plans. A longer preparation period can produce a clearer history without manufacturing documents.
Keep visa compliance records alongside the relationship evidence, including relevant residential and employment information. Where the couple maintains two addresses because of visa or work obligations, explain the actual arrangement accurately.
Confirm the legally workable filing date before submission and review the law again if circumstances change. A restriction assessed today should not become an unexamined assumption months later.
Partner visa requirements: the legal essentials
A partner visa generally requires an eligible Australian citizen, permanent resident or eligible New Zealand citizen partner and satisfaction of the relevant sponsorship rules. The relationship must meet the spouse definition in section 5F or de facto definition in section 5CB of the Migration Act 1958: a genuine, continuing partnership, mutual commitment to a shared life to the exclusion of others, and the required living arrangements. A marriage must be recognised as valid; de facto partners must meet the relevant definition.
Regulations 1.15A and 1.09A address relationship circumstances. Regulation 2.03A sets the usual de facto duration requirement and exceptions, including qualifying prescribed registration. Registration addresses duration, not every criterion. A valid application under section 46 and the relevant Schedule 1 requirements is essential. The applicable Schedule 2 subclass criteria, health, character and other requirements also need assessment. Frequently asked questions
Does an Australian spouse automatically let a 491 holder apply for an 820 immediately?
No. Check the 491-related three-year application restriction and the precise legal requirements. Relationship eligibility and application validity are different issues.
Can relationship registration remove the three-year rule?
Do not assume so. Registration concerns the de facto duration exception, not every restriction associated with the current visa.
Can I move out of a regional area once I lodge?
Check the visa in effect and its conditions before moving. A partner application does not itself remove regional obligations.
