Bridging Visa Conditions Australia: Work, Travel and Visa Rules
Bridging visa conditions determine whether you can work, travel, and undertake certain activities while your bridging visa operates in Australia. However, Home Affairs does not give every bridging visa holder identical conditions. Your previous visa, current immigration matter, type of bridging visa, and personal circumstances can affect the conditions that apply.
Therefore, never rely on another person’s bridging visa when checking your own rights.
How Do You Check Your Bridging Visa Conditions?
Check two documents:
- Your Bridging Visa grant letter
- Your current VEVO record
VEVO shows your current in-effect visa, period of stay, and applicable conditions. However, VEVO only displays a visa once that visa comes into effect. Therefore, if your substantive visa still operates, VEVO may continue showing that visa even though Home Affairs has already granted you a future Bridging Visa.
Keep your Bridging Visa grant letter because it shows the conditions that will apply when the visa starts.
BVA Conditions
Bridging Visa A conditions vary between applicants.
Some BVA holders can work without restrictions, while others carry employment conditions from an earlier visa. The Migration Regulations allow Home Affairs to continue certain conditions onto a Bridging Visa A in specified circumstances.
Therefore, do not assume that holding a Bridging Visa A Subclass 010 automatically gives you full work rights.
Before accepting employment, check whether your visa contains a work restriction.
What Does “Bridging Visa A No Conditions” Mean?
BVA “no conditions” means Home Affairs has not placed specific numbered visa conditions on that BVA.
However, this does not turn the BVA into permanent or unrestricted immigration status. The visa still operates according to its grant and the underlying immigration matter.
Most importantly, a BVA does not give you a travel facility that allows you to leave Australia and return on that visa.
BVB Conditions
The most important Bridging Visa B conditions usually concern travel.
A BVB can give you a specific period during which you may leave Australia and return. You should check the exact travel dates on your grant notice before booking flights. Do not assume that the BVB allows unlimited overseas travel.
Your BV travel conditions may only permit return to Australia within the travel period Home Affairs grants. A BVB may also continue employment restrictions that applied to your previous bridging visa. The Migration Regulations allow certain existing conditions to carry across to a BVB. Therefore, check both your travel facility and your work conditions.
BVC Conditions
Bridging Visa C conditions can include restrictions on employment. For example, the Migration Regulations apply condition 8101 in certain BVC circumstances. Condition 8101 prevents the visa holder from working. However, different rules can apply in other BVC cases.
Consequently, avoid statements such as “everyone on a BVC cannot work.” Check your actual grant.
If your BVC prevents employment, you may have options to seek different conditions depending on your circumstances. Home Affairs provides a process for eligible BVA, BVB, and BVC holders to apply for another BV or request different conditions.
BVE Conditions
Bridging Visa E conditions can vary significantly because people hold BVEs in different immigration circumstances.
A BVE may contain:
- restrictions on work;
- reporting requirements;
- residential requirements; or
- other conditions that relate to the person’s immigration circumstances.
Therefore, check every condition individually rather than assuming that all BVE holders have the same rights.
If your BVE prevents you from working, do not begin employment simply because you experience financial difficulty. You must first determine whether you can seek work rights and obtain a visa that permits employment.
Can Bridging Visa Conditions Affect Your Work Rights?
Yes.
Work rights create one of the most important differences between bridging visa grants.
A bridging visa may:
- allow unrestricted work;
- restrict the type of work you undertake;
- continue an employment condition from an earlier visa; or
- prohibit work entirely.
The Migration Regulations specifically provide for several employment-related conditions across bridging visa subclasses.
Therefore, check VEVO before starting a job, changing employers, or assuming that your previous work rights continue.
Can You Change Your Bridging Visa Conditions?
In some circumstances, yes.
For BVA, BVB, and BVC holders, Home Affairs provides an application process that can include requests to change current bridging visa conditions.
However, lodging a request does not immediately change your existing conditions.
Continue following your current conditions until Home Affairs grants a visa with different conditions.
The Most Important Rule About Bridging Visa Conditions
Never assume.
Two people can hold the same bridging visa subclass and still face different restrictions.
Before you work, travel, or make a major immigration decision:
- read your grant letter;
- check VEVO;
- identify every numbered visa condition; and
- confirm what each condition allows.
Your individual grant determines what you can actually do.
If your BV conditions restrict your work or create uncertainty about travel, obtain advice before taking action.
