Medicare and Australian Partner Visas: 820, 309, Bridging Visa and Permanent Stage Explained

Medicare eligibility is a major practical concern for Partner Visa applicants, especially where an onshore applicant is waiting on a bridging visa or an offshore applicant has entered Australia before the Subclass 309 is finalised. The key point is that Medicare rules are administered by Services Australia and do not simply mirror the label on your current visa.

Services Australia currently states that people living in Australia who have applied for permanent residence may be able to enrol in Medicare. This expressly includes applicants for the combined 820/801 and 309/100 Partner Visa pathways, subject to the Medicare eligibility conditions.

Can an 820/801 applicant enrol in Medicare before the 820 is granted?

Potentially, yes. Services Australia says that if you live in Australia and have applied for permanent residency, you can enrol where you also meet one of the additional criteria, such as holding a visa with work rights or having a qualifying Australian citizen, permanent resident or New Zealand citizen relative. A combined 820/801 application is specifically included.

What if you are still on a Bridging Visa?

A bridging visa does not automatically answer the Medicare question. The relevant Services Australia test looks at the permanent residence application, residence in Australia, visa work rights and/or qualifying family relationship. Always check the current Medicare enrolment requirements rather than assuming that “bridging visa” means eligible or ineligible.

What changes once the Subclass 820 is granted?

Home Affairs expressly lists access to Medicare as one of the benefits for which an 820 holder can apply. The 820 also carries full work and study rights and multiple travel while it remains in effect.

Can a Subclass 309 applicant get Medicare?

Services Australia expressly includes combined 309/100 applicants in its permanent-residence applicant rules. For an application lodged outside Australia, Medicare eligibility can generally commence from the date the person arrives in Australia to live, provided the remaining enrolment criteria are met. A person who is still living overseas cannot enrol simply because a 309/100 application is pending.

What happens after the 801 or 100 is granted?

Subclass 801 and Subclass 100 are permanent visas. Permanent residents can enrol in Medicare as Australian residents, subject to Services Australia’s ordinary identity and residence requirements.

What documents may Services Australia ask for?

  • A current passport or ImmiCard.
  • Evidence from Home Affairs that a permanent residence application has been lodged.
  • Current visa details.
  • Where needed, evidence of the qualifying spouse, parent or child relationship.

Illustrative case example: onshore Partner Visa lodged while on a Visitor Visa

Composite example: An applicant lodged an 820/801 application while holding a Visitor Visa and assumed she had to wait until the 820 grant before applying for Medicare. The correct question was whether she met the Services Australia criteria as a person living in Australia who had applied for permanent residence, including the work-rights or qualifying-relative limb. The Medicare assessment was therefore separate from the Department’s processing time for the 820.

Do not confuse Medicare with the Partner Visa health requirement

Medicare enrolment is about access to Australia’s public health system. The visa health requirement is a separate immigration assessment. A person can be Medicare-eligible and still have to complete immigration medical examinations or address a health criterion.

General information only. Medicare eligibility is administered by Services Australia and should be checked against your current circumstances.
