Running a Business Together: Partner Visa Evidence for Self-Employed Couples

By Madhab Kharel, Principal Lawyer · Sources checked 26 October 2026

When you run a business together, your financial records can look more like a company’s paperwork than a couple’s shared life. Payments pass through different accounts, one partner draws a salary, and the other contributes unpaid administrative work. A joint business can explain important parts of the relationship, but business collaboration alone does not establish a partner relationship.

The aim is to show what belongs to the enterprise, what belongs to your household, and how the two connect. You do not need to disclose every customer’s information to make that explanation clear.

For ordinary living costs, see our financial evidence guide. This article concentrates on the additional questions that arise for self-employed couples using the 820/801 pathway or its offshore equivalent.

Key points before you start

  • Business collaboration alone does not prove a partner relationship.
  • Distinguish turnover, wages, drawings and household spending.
  • Protect unrelated customer and employee information.

Business partners and life partners are different relationships

Two people can own shares, sign a lease or work long hours together without being spouses or de facto partners. Conversely, genuine couples may run an enterprise owned by only one person. Neither business ownership model determines the visa result.

The migration assessment still concerns the applicable relationship definition and visa requirements. Business material is useful when it supports a particular fact: a shared financial responsibility, a decision made together, or the way work affects the household. It should be considered alongside the wider relationship history.

Start by writing two short descriptions. The first explains each person’s business role. The second explains your domestic and personal relationship. Where those descriptions overlap, identify the records that make the connection understandable.

Is the enterprise a sole trader business, partnership, company or trust? Who owns it? Who is employed, who has authority to operate accounts, and when did each person become involved? Use accurate terms rather than calling every arrangement a joint business.

An ABN record does not necessarily show ownership of a company. Being a director, shareholder, beneficiary or employee involves different roles. Your accountant or business lawyer may need to clarify the structure before it is described in a relationship statement.

Avoid treating turnover as personal income. A business receiving substantial revenue may also have rent, wages, loans and supplier costs. If you rely on the business to explain financial support, show the amount actually available to the household and the basis for that explanation.

Trace the bridge between business and household accounts

A practical evidence map can have four columns: transaction, business purpose, recipient and household relevance. A salary payment may show how one person funds living expenses. A shareholder loan may need a different explanation. A supplier payment may have no useful relationship relevance at all.

For example, money transferred from a company account to a personal account should not automatically be labelled shared savings. Check whether it was wages, a dividend, a reimbursement, a loan or another properly recorded payment. The description should agree with the underlying records.

Do not rearrange transactions retrospectively to produce a more attractive visa narrative. If the accounting treatment was wrong, obtain accounting advice about correcting it. A migration explanation is not a substitute for compliant bookkeeping.

Show each person’s actual contribution

Couples contribute in different ways. One person might meet clients while the other manages rosters, deliveries or household tasks that enable the enterprise to operate. Explain the arrangement without inflating a role that cannot be supported.

Relevant records may include existing employment documents, ownership records, authorised account access, dated correspondence about major decisions, and a focused accountant’s explanation. Use only material appropriate to the point being proved.

If a partner provided unpaid work, check the immigration and employment implications separately. Describing it as helping family does not decide whether it was work for visa purposes. Do not assume that an overseas customer base, a small business or an absence of wages removes visa condition issues.

Keep business evidence balanced with household evidence

A file containing only tax returns and invoices may leave the personal relationship unexplained. Show where you live, how ordinary expenses are paid, how domestic responsibilities operate and how friends or family know you as a couple, where relevant.

Business travel also needs context. A hotel booking for a trade exhibition may show both people travelled, but not necessarily why the trip supports the relationship. State whether it included time together, a family visit, or simply work. Avoid relabelling a work event as a romantic milestone.

For household arrangements, use our nature of household guide. It provides the broader framework without requiring your business documents to carry the entire application.

Protect customer, employee and commercial information

Large accounting exports can contain bank details, payroll information and customer records that are irrelevant to the relationship. Discuss an appropriately limited evidence set with your lawyer. Retain complete originals and clearly identify any lawful redactions or extracts.

An accountant’s letter should say what records were examined and which facts can be confirmed. It should not offer a migration conclusion outside the accountant’s knowledge. A precise explanation of drawings and shared expenses is more useful than an unsupported statement that the visa must be granted.

If Home Affairs specifically asks for a complete document, respond to that request. Do not assume that a privacy concern permits omission of material necessary to understand the evidence; obtain advice about the appropriate way to provide it.

Fictional example: one company, two different roles

Sam owns a consulting company established before meeting Mei. Mei later becomes an employee. They share a home, but Sam keeps the company shares in his own name. Their first draft says they jointly own and operate everything.

A factual review identifies the problem. The revised account distinguishes ownership from Mei’s employment and explains their shared household spending. It uses limited business records to confirm roles and income, then separate domestic evidence to explain their life together.

The application does not need a fabricated ownership arrangement. It needs an accurate explanation that remains consistent if the Department compares it with corporate and tax records.

Before submitting the business documents

Check dates of business registration, employment commencement, relationship development and cohabitation. Where your involvement began before the romantic relationship, say so. Work history should not be stretched to extend the claimed relationship duration.

Review any earlier visa applications mentioning employment or business activity. If the current description differs materially, identify whether this is a genuine change, an earlier error or an issue requiring legal advice. Preserve the original records and respond promptly to any request.

Frequently asked questions

Must both partners own shares?

No standard ownership percentage proves a genuine relationship. Explain the real structure and the wider shared life. Do not transfer shares simply to create a visa document without commercial, tax and legal advice.

Can an accountant certify that our relationship is genuine?

An accountant can explain matters within their knowledge and records. The visa decision remains a legal assessment by Home Affairs. An accounting opinion cannot replace evidence about the personal relationship.

Is business turnover proof that the sponsor can support us?

Turnover is not the same as disposable income. Explain genuine household resources and liabilities. The broader question about sponsor income is addressed in our existing sponsor financial requirements guide.
