PIC 4020: False or Misleading Information, Bogus Documents and Visa Refusal Risk
PIC 4020 is a public interest criterion that can create serious problems where a visa application involves a bogus document, materially false or misleading information, or specified identity concerns. It can also have consequences beyond the immediate application because some PIC 4020 findings are relevant to later visa applications.
The correct response depends on exactly which part of PIC 4020 is in issue and which visa subclass requires the criterion.
What does PIC 4020 deal with?
Schedule 4 of the Migration Regulations contains PIC 4020. The criterion addresses, among other things, whether an applicant has given or caused to be given a bogus document or information that is false or misleading in a material particular in connection with the relevant application or certain earlier visas.
It also contains separate identity-related provisions. The consequences and relevant periods differ depending on the type of finding.
A mistake is not automatically the same as fraud
Visa forms are long and factual mistakes happen. The legal issue is not resolved simply by labelling an error “innocent” or “fraudulent”. The nature of the information, its materiality, how it came to be provided and the applicable legal test all require analysis.
If you discover an incorrect answer before a decision, seek advice about correcting the record promptly rather than hoping the discrepancy will not be noticed.
What is a bogus document?
The Migration Act contains a statutory definition of a bogus document. The concept can extend beyond a completely fabricated document and can involve documents altered or obtained in circumstances that fall within the legal definition.
Do not assume that a document is safe merely because it was supplied by an employer, education agent, relative, or third party. Applicants should understand what is being submitted in their name.
Examples of issues that can trigger scrutiny
- altered employment references or payslips;
- bank documents that cannot be verified;
- incorrect relationship histories;
- false qualifications or work experience;
- contradictory information across previous visa applications;
- documents generated by an agent without the applicant checking them;
- identity documents with inconsistent personal details; and
- answers that conceal prior refusals, relationships or immigration history.
What happens if Home Affairs raises PIC 4020?
The Department may invite an applicant to comment on adverse information before making a decision where the statutory procedural requirements apply. The response should address the actual allegation, the evidence and the legal criterion rather than provide a generic character statement.
If you receive a natural justice invitation, preserve the original documents and obtain the complete application record. Avoid creating retrospective documents that could make the evidentiary problem worse.
Can PIC 4020 affect future applications?
Yes. The current regulations contain look-back provisions connected to prior refusals for failure to satisfy particular parts of PIC 4020. The relevant period differs for some identity findings. Whether a later visa requires PIC 4020 must also be checked.
This is why a refusal should not be treated as a problem affecting only one application.
Are there waiver provisions?
Some aspects of PIC 4020 include specified exceptions or waiver mechanisms in defined circumstances. Their availability depends on the precise provision engaged and the facts. They are not a general discretion to overlook unreliable evidence.
What if an agent supplied the false information?
Applicants often say that an agent prepared the application. That fact can be highly relevant, but it does not automatically resolve the legal issue. Gather the retainer, emails, draft forms, messages, invoices and evidence showing what information you gave the representative and what you were asked to approve.

Preparing a response or review case
Build a chronology identifying:
- what information or document is challenged;
- who created or supplied it;
- when it was provided;
- what the applicant understood at the time;
- why it is said to be false, misleading or bogus;
- what independent evidence exists; and
- what legal part of PIC 4020 is alleged to apply.
