Can You Marry Outside Australia on a Subclass 300 Prospective Marriage Visa?
Yes. A Subclass 300 Prospective Marriage Visa holder can marry their sponsoring prospective spouse in Australia or overseas. Home Affairs expressly states that the marriage can take place in any country, provided it occurs before the Subclass 300 expires and is valid under Australian law.
This is useful for couples who want a wedding in Nepal, India, the Philippines, Europe, the United States or another country for family, cultural or religious reasons.
Does the wedding have to take place in Australia?
No. The Prospective Marriage Visa lets the holder travel to and from Australia as many times as they want while the visa is valid. That means the couple can enter Australia on the 300, later travel overseas for the wedding and return while the visa remains valid.
What makes an overseas marriage valid for Australian Partner Visa purposes?
Australia generally recognises an overseas marriage if it was valid under the law of the country where it occurred and is not excluded by Australia’s marriage-recognition rules. Obtain the official marriage certificate issued by the relevant authority and arrange an English translation if the document is not in English.
Do you need to return to Australia before the 300 expires?
If you intend to lodge the onshore 820/801 Partner Visa, the primary applicant must be in Australia when that application is lodged. The couple should therefore plan the overseas wedding, return travel, certificate availability and 820/801 preparation against the exact Subclass 300 expiry date.
What if the marriage certificate takes weeks to issue?
This is a common planning problem. Do not assume a ceremonial certificate will always be enough. If the foreign civil registry takes time to issue the official record, factor that delay into the wedding date. The 820/801 application should include reliable evidence that the marriage is legally valid.
Can you work and travel before the overseas wedding?
Yes. While the Subclass 300 remains valid, Home Affairs states that the holder can live, work and study in Australia and travel internationally multiple times. Check the actual grant notice and VEVO before departure.
Case example
A Subclass 300 holder entered Australia but the couple wanted their wedding in Kathmandu so both families could attend. They travelled overseas while the 300 remained valid, completed a legally valid marriage, obtained the official marriage certificate and returned to Australia before the visa expired. The couple then lodged the 820/801 Partner Visa application onshore using the Subclass 300 pathway.
Overseas wedding checklist
- Check that the Subclass 300 will remain valid for departure and return.
- Confirm the marriage will be legally valid in the country of ceremony.
- Allow time to obtain the official marriage certificate.
- Arrange a compliant English translation where required.
- Return to Australia in time to prepare and lodge the 820/801 before the 300 expires.
Home Affairs confirms the overseas-marriage rule and multiple travel rights on the Subclass 300 page. See our Prospective Marriage Visa hub and 820/801 Partner Visa hub.
General information only. Overseas marriage validity and document requirements depend on the law of the country where the marriage takes place.
