494 Visa Refused After Nomination Approval: Review Rights and Next Steps
Updated September 2026. A Skilled Employer Sponsored Regional (Subclass 494) nomination approval is important, but it is not the same as a visa grant. The employee must independently satisfy the visa criteria for the relevant 494 stream.
For legal assistance, see our Subclass 494 service and Sponsorship & Nomination Refusals service.
Why can the visa fail after the nomination is approved?
Visa-level issues may include age, English, skills assessment, work experience, registration or licensing, health, character, identity or another stream-specific criterion. The nomination approval does not decide those applicant-level matters.
Is a 494 visa refusal reviewable?
Some 494 refusals may have ART review rights. The decision letter should identify whether review is available, who is entitled to seek review and the deadline. The employer’s rights in relation to a nomination decision are not necessarily the same as the visa applicant’s rights.
What should be reviewed first?
- Read the exact refusal criterion.
- Check the nomination approval and validity.
- Confirm the applicant’s visa status and any bridging visa.
- Identify whether the refused criterion can be addressed at review.
- Assess whether a fresh nomination and visa application are legally available.
What evidence may matter?
- skills assessment and qualifications;
- employment references and work records;
- English evidence;
- registration or licensing documents;
- nomination approval and regional position evidence;
- health and character documents; and
- a targeted written submission addressing the refusal reasons.
ART or reapply?
What about the pathway to permanent residence?
A 494 refusal can disrupt a planned regional pathway, including future Subclass 191 planning. That makes timing important, particularly if the worker is already in Australia on another sponsored visa.
