Can You Apply for an Aged Parent Visa While on a Visitor Visa? 804, 864, 8503 & Bridging Visas
An older parent visiting Australia may be able to apply for an Aged Parent Visa onshore — but only if the legal conditions for a valid application are actually met. The most common mistake is assuming that age alone is enough. A Visitor Visa can carry a No Further Stay condition, and the difference between Subclass 804 and 864 involves cost, queueing and contributory requirements.
This guide explains when a parent on a Visitor Visa may consider Subclass 804 or Subclass 864, how Condition 8503 can block an onshore application, when a waiver request may be considered, and what happens with bridging visas after a valid application.
Can you apply for an Aged Parent Visa while on a Visitor Visa?
Potentially. The ordinary onshore Aged Parent pathways are Subclass 804 and Subclass 864. The parent must satisfy the relevant application criteria, be in the required location and hold a visa status that permits a valid application.
The first document to check is the Visitor Visa grant letter or VEVO record. If a No Further Stay condition such as 8503, 8534 or 8535 is attached, most temporary and permanent visas cannot be applied for while the parent remains in Australia unless the condition is waived or another lawful exception applies.
What is Condition 8503?
Condition 8503 is a No Further Stay condition. Home Affairs describes this family of conditions as preventing the visa holder from applying for most other temporary and permanent visas while in Australia.
For Parent Visa planning, the practical effect can be decisive: a parent may be old enough for Subclass 804 or 864, satisfy the Balance of Family Test and have an eligible sponsor, but still be unable to lodge a valid onshore application because the Visitor Visa condition blocks it.
How do you check whether 8503 applies?
Read the Visitor Visa grant notification and check VEVO. Do not assume the condition is absent because another family member did not have it, or because a previous Visitor Visa did not contain it.
Sponsored Family stream Visitor Visas commonly carry No Further Stay restrictions. Other Visitor Visas can also have them.
Can Condition 8503 be waived?
Home Affairs permits a waiver request where there has been a major change in circumstances after the visa was granted and the waiver framework is satisfied. The applicant must provide evidence supporting the changed circumstances.
Simply deciding that a Parent Visa would now be more convenient is not enough. Not knowing that the condition was attached is also not a reason for waiver.
Does lodging the waiver request remove Condition 8503?
No. The condition remains in force unless Home Affairs actually waives it. Families should not lodge a Parent Visa on the assumption that a pending waiver request makes the application valid.
Timing matters because the Visitor Visa may expire while the waiver request is still being considered. A waiver request does not by itself extend the substantive visa.
Can you appeal a refused 8503 waiver to the ART?
Home Affairs states that a refusal to waive a No Further Stay condition is not reviewable by the Administrative Review Tribunal. That makes the quality of the waiver request and supporting evidence particularly important.
Subclass 804 vs 864 after a Visitor Visa
| Issue | Subclass 804 | Subclass 864 |
|---|---|---|
| Status if granted | Permanent | Permanent |
| Type | Non-contributory Aged Parent | Contributory Aged Parent |
| Headline VAC | From AUD8,665 | From AUD49,900 direct pathway |
| Queue | Very long non-contributory queue | Contributory queue |
| Onshore bridging visa | Available for eligible valid applicants | Available for eligible valid applicants |
| Balance of Family Test | Yes | Yes |
What age does the parent need to be?
The ordinary 804 and 864 pathways require the primary applicant to be old enough to receive the Australian Age Pension. Age should be checked before deciding that a Visitor Visa can transition into an Aged Parent strategy.
What happens after a valid 804 or 864 application is lodged?
Eligible onshore applications can be associated with a bridging visa. The bridging visa generally becomes relevant when the Visitor Visa ceases. The exact commencement, conditions and work rights are stated on the bridging visa grant.
For 804 applicants, see our detailed BVA/BVB, travel and Medicare guide.
Can the parent travel after lodging?
A Bridging Visa A does not permit re-entry. If the parent needs to leave and return while the substantive Aged Parent Visa remains pending, a Bridging Visa B should be considered before departure. Travel should be planned against the actual visa and bridging-visa dates.
Does applying onshore mean the parent can stay in Australia permanently while waiting?
A bridging visa can provide lawful temporary stay while the substantive application remains undecided, but it is not permanent residence. The parent remains a temporary visa holder until the Aged Parent Visa is actually granted.
That distinction affects travel, Medicare, work rights and access to government support.
Can the parent get Medicare?
Services Australia does not treat every Parent Visa applicant on a bridging visa as automatically Medicare-eligible. Subclass 804 applicants may have pre-grant eligibility where they come from a Reciprocal Health Care Agreement country and satisfy that agreement’s conditions. Permanent Parent Visa grant creates a different Medicare position.
What about a substituted Subclass 600 Visitor Visa?
Some Parent Visa provisions contain special rules for a substituted Subclass 600 visa, generally arising from ministerial intervention. These cases can affect age or health criteria and visa charges in ways that do not apply to an ordinary Visitor Visa holder.
Do not assume an ordinary Subclass 600 granted through the standard visitor process is a “substituted” visa.
Can a parent on a Visitor Visa apply for Subclass 143 instead?
Subclass 143 is a permanent Contributory Parent Visa and its application-location and grant-location rules differ from the ordinary aged-parent onshore bridging pathway. The family should not assume that every Parent Visa lodged in Australia creates the same bridging outcome.
What if the parent is not yet Age Pension age?
Ordinary Subclass 804/864 eligibility may not be available yet. The family can consider other lawful options, which might include Subclass 103, 143, 173, 870 or a Visitor Visa depending on the objectives and criteria. Avoid constructing a future onshore strategy around an age threshold the parent has not yet reached.
Case example: 70-year-old parent with 8503
A parent arrives on a Visitor Visa, is old enough for the aged-parent criterion and appears to pass the Balance of Family Test. However, the Visitor Visa carries Condition 8503. The parent cannot simply lodge 804 because the family prefers a bridging visa. The first legal question is whether there are grounds for a No Further Stay waiver and whether the condition is actually waived before any Parent Visa is lodged.
Check the Visitor Visa before planning the Aged Parent Visa
Age, sponsorship and family balance are only part of the analysis. Condition 8503 can make an otherwise attractive onshore Parent Visa strategy invalid if it is not dealt with lawfully.
Visitor Visa to Aged Parent Visa FAQs
Can I waive 8503 because my child wants me to stay?
A preference to stay is not enough. Home Affairs requires a qualifying major change in circumstances and supporting evidence.
Will a pending waiver request keep me lawful after my Visitor Visa expires?
No. A waiver request does not itself extend the Visitor Visa or grant a bridging visa.
Can I lodge 804 first and fix 8503 later?
If the No Further Stay condition prevents a valid application, lodging first can create an invalid application problem. The condition should be resolved before relying on the Parent Visa lodgement.
Can I work after lodging 804 or 864?
Work rights depend on the conditions of the relevant substantive and bridging visas. Do not assume full work rights.
Can I travel on the Bridging Visa A?
No. A BVB is the bridging visa designed to permit travel and re-entry during a specified period.
Does 864 process immediately because it is contributory?
No. It remains capped and queued, although the contributory queue is more recent than the non-contributory aged-parent queue.
Why the Visitor Visa stream matters
A standard Tourist stream Visitor Visa and a Sponsored Family stream Visitor Visa can have different practical risk profiles. Sponsored Family stream grants commonly include Condition 8503, while other Visitor Visas may also have it. Families should not choose a visitor stream on the assumption that it will later permit an onshore Parent Visa.
Can you ask Home Affairs not to impose 8503 before the Visitor Visa is granted?
You can present the Visitor Visa application honestly and explain the intended stay, but the Department determines which conditions attach. There is no entitlement to a Visitor Visa without a No Further Stay condition merely because the family may later consider an Aged Parent Visa.
A Visitor Visa should be applied for for a genuine visit, not as a disguised commitment to remain permanently in Australia.
What kinds of changed circumstances may support a waiver request?
The legal test is fact-specific. Examples can involve serious and unexpected health events, family emergencies or other major developments arising after grant. The key is that the relevant circumstances changed after the condition was imposed and the evidence explains why they are compelling enough to justify waiver consideration.
A pre-existing intention to lodge an 804 after arrival is fundamentally different from an unforeseen post-grant event.
What evidence should accompany a No Further Stay waiver request?
- medical or hospital evidence if the change is health-related
- evidence of the event occurring after visa grant
- statements explaining the chronology and why departure is now exceptionally difficult
- supporting evidence from family members or professionals where relevant
- current passport, visa grant and contact details
The request should be evidence-driven and accurate. Exaggeration can damage credibility in later immigration dealings.
Can the parent stay in Australia just because a waiver is pending?
No. The underlying Visitor Visa expiry remains important. A waiver request does not create a bridging visa and does not extend the visitor stay. If the current visa is close to expiry, obtain urgent advice about lawful status rather than assuming Home Affairs will decide the waiver first.
What if the parent becomes unlawful while waiting?
Unlawful status can make the situation substantially more complex and may affect the ability to lodge another visa. Do not deliberately allow the Visitor Visa to expire as a strategy to force an onshore Parent Visa pathway.
Why 864 may be considered instead of 804
If the parent can validly apply onshore and the family can meet the significantly higher contributory costs, Subclass 864 places the parent in the contributory aged-parent queue rather than the much older non-contributory 804 queue. Both are permanent if granted and both can support a bridging-visa strategy for eligible applicants.
What if the family wants the temporary 884 first?
Subclass 884 can be a temporary contributory aged-parent stage before 864. Its lodgement method and fee structure differ from 864. Families considering a staged pathway should compare total charges, temporary status and the later permanent application.
Case example: 72-year-old parent with Visitor Visa and no 8503
The parent meets the aged criterion, passes the Balance of Family Test and has an eligible sponsor. An onshore aged-parent application may be legally available, subject to the remaining criteria. The family can then compare 804 and 864 based on cost and queue rather than spending time on an unnecessary 8503 waiver.
Case example: 72-year-old parent with mandatory 8503
The same family facts do not make the Parent Visa valid if 8503 prevents application. Unless Home Affairs waives the condition or another legal pathway exists, the parent cannot simply lodge 804 or 864 while in Australia. The visa-condition analysis comes before the Parent Visa strategy.
Visitor-to-Parent Visa pre-lodgement checklist
- Check the visa grant letter and VEVO for 8503, 8534 or 8535.
- Confirm the exact Visitor Visa expiry date and permitted period of stay.
- Confirm the parent meets the aged-parent criterion for 804/864.
- Calculate the Balance of Family Test before paying fees.
- Check sponsor eligibility and residence history.
- Compare 804 and 864 costs and queue strategy.
- Understand when any bridging visa would become active.
- Plan travel and Medicare/private-health arrangements for the waiting period.
Why a genuine Visitor Visa history still matters
A parent can lawfully visit family and later experience changed circumstances, but a Visitor Visa application must be truthful about the intended temporary visit. Families should not provide false information to obtain a Visitor Visa with the undisclosed plan of remaining permanently. Previous statements to Home Affairs can be reviewed in later migration applications, and inconsistencies can create credibility or integrity concerns beyond the Parent Visa itself.
