Can You Apply for Another Visa While Your Partner Visa Is Processing?

Yes, in some circumstances you can apply for another Australian visa while a Partner Visa application is still pending. But whether you should do so is a different question. A second visa application can affect your bridging visa position, travel plans and—after a Subclass 820 grant—your eligibility for the permanent Subclass 801 stage.

This article focuses on the interaction between a pending Partner Visa and another visa application. For the underlying Partner Visa pathways, see our Partner Visa lawyers Australia hub.

A pending Partner Visa does not automatically stop every other visa application

Australian migration law does not impose one universal rule saying that a person with a pending Partner Visa can never make another visa application. The real issues are whether the second application is valid, what visa conditions or statutory bars apply, and what happens if the second visa is granted.

If you are waiting for an 820 decision

An onshore 820/801 applicant may be holding a substantive visa or may later move onto a Bridging Visa A. If another visa is lodged, you need to understand which bridging visa is connected to which application and what happens if one application is decided first. Do not assume that the newest bridging visa shown in ImmiAccount is necessarily the one that will govern every future event.

The major warning after an 820 is granted

Home Affairs expressly warns Subclass 820 holders not to get another visa. To be granted the permanent Subclass 801, you must hold the 820 or, in relevant cases, a Subclass 445 Dependent Child visa. If another visa is granted, you can lose eligibility for the 801. This makes post-820 visa strategy especially important.

What if your 309 application is processing offshore?

A person waiting for a Subclass 309 may apply for another visa to enter Australia if they meet that visa’s requirements. Home Affairs specifically states that a person waiting for a substantive or permanent visa may be able to apply for another visa to visit Australia. A Visitor Visa is assessed separately and does not give work rights.

Could another visa cancel your bridging visa?

The effect depends on the visa granted and the bridging visa in force. Australian visas do not operate like parallel memberships that can simply be stacked indefinitely. A new substantive visa can replace an earlier substantive visa, and bridging visa operation depends on the applications and decisions to which it is linked.

Illustrative case example: skilled visa invitation while 820 is pending

Composite example: An applicant had lodged an 820/801 application and later received an opportunity to pursue a skilled visa. The couple initially treated the second pathway as “free insurance”. The legal review instead mapped the timing of each application, the applicant’s current substantive visa, bridging visas, likely decision order and the effect a future grant could have on the Partner Visa pathway. The decision was then made strategically rather than assuming two visa applications could run without consequence.

Questions to answer before lodging another visa

  • Are you legally able to lodge the second visa application?
  • Do section 48, Schedule 3 or visa conditions affect validity?
  • Which bridging visa will be in effect and when?
  • Could the second visa be granted before the Partner Visa?
  • Would that grant affect the 801 or 100 permanent stage?
  • Are you considering the second visa because the Partner Visa is genuinely unsuitable, or only because processing is taking time?
