Australia Spouse Visa From India: Subclass 309/100 Documents and Relationship Evidence

Updated September 2026. An Indian citizen who is the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen may be eligible for the offshore Partner Visa pathway: Subclass 309 followed by Subclass 100.

For legal advice, see our Partner Visa 309/100 service.

Is an Indian marriage certificate enough?

No. A legally valid marriage is important, but Home Affairs also assesses whether the relationship is genuine and continuing. Couples should provide evidence across the financial, household, social and commitment aspects of the relationship.

Common documents for couples applying from India

  • passports and identity documents;
  • marriage certificate or registration documents;
  • wedding and family-event evidence;
  • joint financial evidence;
  • communication history where the couple has lived apart;
  • travel records and visits;
  • Indian PCC and other police certificates where required;
  • Form 888 supporting statements; and
  • statements explaining the history and future of the relationship.

What if the wedding was arranged by family?

An arranged marriage is not disqualifying. The application should accurately explain how the relationship began, the role of family, how the couple developed their relationship, their communication, decisions and future plans. The evidence must show a genuine relationship rather than rely on assumptions about cultural practice.

What if the couple has spent little time living together?

Many India–Australia couples spend periods apart because of work, study, family or visa constraints. The application should explain those periods and provide evidence of continuing communication, financial support, visits and joint decision-making.

Do Indian-language documents need translation?

Documents not in English should be accompanied by an acceptable English translation in accordance with Home Affairs requirements. This can include documents in Hindi, Punjabi, Gujarati, Tamil, Malayalam, Telugu or other Indian languages.

How long does a 309 visa take from India?

Home Affairs processing times are global and based on recently finalised applications. There is no guaranteed India-specific timeframe. Completeness, checks, sponsor issues and requests for further evidence can all affect timing.

What if the applicant has a previous marriage?

Provide legally valid evidence showing the earlier relationship ended, such as a divorce order or death certificate. Overseas divorce recognition can become complex if the history involves multiple jurisdictions.
