ACT Civil Partnership Registration for a Partner Visa: Canberra Residency and the Correct Law
Canberra couples considering a partner visa can easily encounter an outdated reference to the ACT Civil Partnerships Act 2008. The current ACT civil partnership process sits under the Domestic Relationships Act 1994. Getting the legal label right is a good start; understanding what it changes is the useful next step.
This guide focuses on ACT registration, residence evidence and the federal connection. For the complete onshore visa pathway, use our Partner Visa 820/801 page.

Key points before you start
- Use current ACT guidance under the Domestic Relationships Act 1994.
- The process asks for evidence of more than three months of ACT residence.
- A ceremony and an official certificate serve different roles.
Why register? First identify the problem you need to solve
Not every couple looking for a relationship certificate has the same legal problem. A qualifying local registration may be relevant if you meet the ACT’s rules. A useful assessment separates three situations.
Your de facto history is under 12 months
You may have strong evidence of a genuine partnership but not the ordinary duration. A prescribed registration can be an important exception where it is lawfully available. It does not manufacture the substantive relationship.
Your relationship is older, but documents are thin
No joint lease or joint bills does not automatically mean no eligibility. Establish the real history and other reliable evidence. Registration may formalise status and address duration, but credible relationship evidence still matters.
You want to formalise an established partnership
You may already meet the ordinary duration and have ample evidence. Formal recognition can be a personal choice. Understand the legal consequences rather than treating a certificate as compulsory for every partner visa.
When can registration be the decisive available route? In a particular case, a couple may have a genuine shorter de facto partnership, not choose marriage, have no other applicable duration exception and wish to apply without waiting. If they genuinely qualify for a prescribed scheme and satisfy the relevant timing and remaining visa criteria, registration may be the only presently available duration exception for that proposed de facto application. That is different from saying it is the only way to prove every aspect of eligibility.
The legal starting point is regulation 2.03A of the Migration Regulations 1994, read with the section 5CB de facto definition. The usual 12-month period concerns the de facto relationship. It is not a universal standalone rule requiring 12 months of a joint lease or uninterrupted cohabitation. Dating, living together and forming a shared-life partnership must be explained on their actual facts.
ACT civil partnership registration cost: why the fee table needs careful reading
Canberra couples often search for the cheapest way to register a de facto relationship for a partner visa. The useful answer starts with actual ACT eligibility, not a price comparison. The ACT process requires genuine residence evidence, including the period described in the current application instructions. A low fee is not permission to use a Canberra address where you do not live.
The Access Canberra forms and fees table, headed 2026–2027, lists nil for civil partnership registration and $53 for a standard certificate. These published items were checked on 27 October 2026. Confirm the current charge and any postage through the official service before completing an order.
The listed commemorative certificate is $66, or $91 for the standard and commemorative combination. Those are certificate products, not a reason to assume a decorative certificate can replace the official record requested by Home Affairs. A private ceremony, translations, replacement documents and professional advice are separate potential costs.
There is no need to invent a registration fee where the official table says nil. Equally, “registration is free” should not be turned into “the entire visa evidence process costs nothing”. The standard certificate, necessary supporting records and the visa application itself are different matters. Any fee-waiver request for a certificate must be assessed under the actual requirements; it is not automatic because the enquiry concerns a partner visa.
How to register a civil partnership in the ACT: step by step
- Check eligibilityConfirm actual residence, relationship status and the appropriate legal category.
- Prepare the recordsOrganise identity, prior relationship documents and the required declarations.
- Complete the official processUse the correct submission route and allow for its real waiting and processing periods.
- Use the official record properlyCheck the certificate and connect it with the genuine relationship and visa criteria.
Step 1: Check the current legal framework and eligibility
The current civil partnership process is under the Domestic Relationships Act 1994, not a new application under the repealed Civil Partnerships Act 2008. Access Canberra explains the recognition of older partnerships registered under the former Act. An older certificate therefore needs its legal history checked rather than an automatic assumption that it is useless.
Both people must be adults and satisfy the restrictions involving marriage, civil unions, civil partnerships and prohibited relationships. At least one must live in the ACT. Read the current registration guidance and application rather than relying on a third-party summary of the old scheme.
Step 2: Establish the ACT residence period with real records
The advertised process asks for proof that at least one person lives in the ACT and has done so for more than three months. The application form asks for the specified residence material. This is not the same as having a Canberra postal address or having stayed with a friend for a weekend.
Identify when the relevant partner actually began residing in the ACT and assemble records showing the physical address and period. A lease signed today may establish a current arrangement without establishing the earlier period by itself. The strength of the evidence depends on what it shows, not how many times an address is typed into the application.
Step 3: Be precise about the NSW–ACT border
Queanbeyan, Jerrabomberra and other NSW addresses are not ACT addresses merely because the couple works or spends time in Canberra. Check the actual jurisdiction of the home. A genuinely split household should describe who lives where and when.
If NSW is the relevant residence, the NSW relationship registration guide explains a separate process. Do not use the ACT route simply because it appears cheaper or because someone says its registration is quicker. Eligibility comes before shopping for a fee or timetable.
Step 4: Prepare identity and earlier relationship records for both partners
Access Canberra’s current guidance asks both people for three forms of identification, including at least one primary document, and the required evidence of earlier relationship endings. Follow its accepted identity and residence lists rather than assembling an informal three-document combination.
Check names and dates against passports and civil records. If a name differs, provide the genuine linking explanation. If a former marriage or registration has not legally ended, resolve that issue before making declarations. A new relationship certificate does not erase a previous legal status.

Step 5: Choose the official online or form-submission route
Access Canberra advertises an online application and a downloadable form that can be submitted through the identified email, service-centre or postal channels. Use the current civil partnership application and follow the instructions for the chosen route.
The form addresses identity verification and what to do if the applicant does not consent to the specified digital verification process. Follow the official alternative rather than assuming an online preference removes the need for identity checks. Retain a copy of the final material and confirmation of submission.
Step 6: Complete the declarations and any ceremony-related parts correctly
A ceremony is optional under the advertised ACT process. If one is chosen, follow the relevant official instructions and distinguish the ceremony from registration and certificate issue. Do not assume hiring a celebrant automatically completes the Registry process.
For a registration without a ceremony, the application contains instructions about official endorsement by the Registrar-General or Deputy Registrar-General. Complete the required applicant declarations and follow the form’s execution and submission instructions. Do not ask an arbitrary private witness to complete a section reserved for an authorised official.
Step 7: Track registration separately from ordering a certificate
Keep the application reference and respond to genuine requests for outstanding material. Then check how the certificate will be requested or issued under your selected process. An application to register and an application for a copy of an official certificate are not automatically the same transaction.
Access Canberra publishes a 15-business-day processing period for the certificate request once all required documents are received, excluding Australia Post delivery. Do not convert that into a guaranteed end-to-end registration time or import another state’s 28-day period without checking the ACT process. Ask Access Canberra about the actual registration timetable where timing is critical.
Step 8: Obtain the official record and check the details
Check full names, registration details and the type of certificate. Preserve the original and use a legible copy for the visa. If a document is wrong, obtain the appropriate official correction. A commemorative version should not be substituted for a standard certificate simply because it is easier to find in the folder.
Keep registration and relationship dates separate. Our de facto start-date guide explains how the substantive partnership may develop before a formal event. Do not automatically use the certificate issue date as the beginning of every aspect of the relationship.
Step 9: Apply the federal duration exception and remaining visa criteria
The federal prescribed-law instrument identifies the relevant ACT civil partnership under the current legislation. That can make registration important under regulation 2.03A. It does not make the state certificate a complete partner visa eligibility assessment.
Use the 820/801 Partner Visa page for the full onshore framework, or 309/100 for the offshore pathway. Check validity, sponsor status and restrictions, health, character and evidence of the substantive relationship. The Registry cannot waive a visa condition or extend immigration permission.
When ACT registration may be the decisive duration route
Consider fictional partners in Belconnen who have a genuine de facto partnership of eight months. One has lived in the ACT long enough to meet the residence requirement, and the couple meets the other state rules. They do not wish to marry and an assessment identifies no other applicable duration exception.
A qualifying registration may be the decisive available means of addressing the duration requirement for the proposed timing. It still requires an actual shared partnership and a valid visa application. A low registration fee or an expected certificate turnaround cannot substitute for those legal foundations.
Now consider partners who have only recently begun dating and have future plans but have not formed the required de facto partnership. Registration should not be described as manufacturing a substantive relationship that does not yet exist. The state application and migration tests need separate, careful answers.
What if you have lived together for over a year but have no joint lease?
A couple in Canberra may live in one person’s existing tenancy or with relatives. Some may split expenses in ways that do not produce matching transfers. Explain the real arrangement and assemble evidence showing the relationship over time.
Registration may formalise the status and address the duration exception where relevant. It does not explain every documentary gap or inconsistency automatically. The question is what other reliable evidence establishes the shared life, including household arrangements, financial cooperation, social recognition and commitment.
Do not create a false lease or claim a different address to make the file tidier. The household evidence guide provides more detail on actual living arrangements without standard tenancy paperwork.

Formalising an established relationship: more than a migration document
An established couple may want a civil partnership even if they already satisfy the ordinary duration requirement. It can be a personal legal milestone or provide an official record for appropriate dealings. That choice does not have to be justified by pretending the relationship is newer or less documented than it is.
Access Canberra warns that federal and other jurisdictions may not recognise the partnership in exactly the same manner as ACT law. Consider separate property, estate or personal planning advice where relevant. Registration is not the same as marriage, and its effects should not be assumed to be identical everywhere.
For a later relocation, read the interstate moving guide. For different certificate categories, use the registration-category guide. Update actual addresses and check current visa conditions rather than preserving an outdated ACT address for convenience.
ACT pre-submission checks
- Confirm the actual ACT resident and evidence of more than three months’ residence.
- Check the home’s jurisdiction rather than relying on proximity to Canberra.
- Prepare each partner’s required identity and earlier relationship records.
- Use the current online service or form and complete the correct declaration sections.
- Distinguish optional ceremony, registration and certificate request.
- Confirm the standard certificate charge and any delivery costs.
- Obtain migration advice before relying on a particular application or completion date.
What registration can address—and what the evidence still needs to show
| Question | Role of a qualifying registration | What still needs attention |
|---|---|---|
| Usual de facto duration | May engage the prescribed-registration exception. | The precise criterion, relevant timing and actual registered status. |
| Genuine shared partnership | Provides a formal legal event and relevant evidence. | The substantive de facto definition and credible account of the shared life. |
| Household and finances | Does not describe every arrangement before or after registration. | Actual residence, responsibilities, support and explanations for missing conventional records. |
| Visa permission and validity | Does not extend a visa or automatically remove an application restriction. | Current status, conditions, sponsorship, health, character and the applicable subclass criteria. |
If a joint lease is missing, explain why and consider other reliable evidence. If the relationship itself is too short for the ordinary duration requirement, identify an actual exception rather than inventing an earlier start date. If formalisation is a personal choice, understand the legal effects beyond immigration.
Partner visa requirements: the legal essentials
A partner visa generally requires an eligible Australian citizen, permanent resident or eligible New Zealand citizen partner and satisfaction of the relevant sponsorship rules. The relationship must meet the spouse definition in section 5F or de facto definition in section 5CB of the Migration Act 1958: a genuine, continuing partnership, mutual commitment to a shared life to the exclusion of others, and the required living arrangements. A marriage must be recognised as valid; de facto partners must meet the relevant definition.
Regulations 1.15A and 1.09A address relationship circumstances. Regulation 2.03A sets the usual de facto duration requirement and exceptions, including qualifying prescribed registration. Registration addresses duration, not every criterion. A valid application under section 46 and the relevant Schedule 1 requirements is essential. The applicable Schedule 2 subclass criteria, health, character and other requirements also need assessment. This is a brief orientation; use the linked subclass page for the complete pathway and obtain advice on your circumstances.

Frequently asked questions
Is ACT civil partnership registration free?
The published table headed 2026–2027 lists nil for registration. The standard certificate is a separate listed $53 item. Confirm current fees and any delivery charges through the official service.
Does one partner need more than three months in the ACT?
The current registration guidance asks for proof that at least one partner lives in the ACT and has for more than three months. Check the required evidence and actual residence history.
Can we use a Queanbeyan address for ACT registration?
Do not describe a NSW address as ACT residence. Identify the actual home and jurisdiction, then assess the process genuinely available.
Is there a compulsory ACT civil partnership ceremony?
Access Canberra describes a ceremony as optional. Follow the correct process for the route chosen and obtain the official registration record.
Will everything be finished in 15 business days?
Do not assume so. The published period discussed here concerns certificate requests after receipt of all required documents, excluding delivery. Confirm the registration timetable separately.
Do we need to register again because our certificate mentions the 2008 Act?
Not automatically. Access Canberra explains the recognition of partnerships under the repealed Act. Check the actual status and history before applying for anything new.
Does registration replace proof of a genuine relationship?
No. It may address the duration exception but not the substantive de facto relationship or the remaining visa criteria.
Can a later certificate fix a visa application already lodged?
Timing requires individual advice. Read our post-lodgement registration guide before assuming a later formal event cures an earlier problem.
